- Reasons for granting the exemption—The reasons for granting this exemption are:
(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) Contact is implementing a major system upgrade that will temporarily affect its ability to comply with some switching, registry management and submission processes within the timeframes specified in the Code;
(c) the exemption will permit Contact to shut down its existing legacy systems, migrate data, test, and manually correct errors occurring during the final cutover to the new system, without the potential interruption of managing multiple breach notices from other participants; and
(d) the exemption will have minimal impact on other participants and service providers, and will not affect any other Code provisions.

Notice of the Electricity Industry Participation (Minor Amendments) Code Amendment 2014

Pursuant to section 38(3)(b) of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives notice of the making of the Electricity Industry Participation (Minor Amendments) Code Amendment 2014.

The amendment comes into force on 15 May 2014.

The amendment makes various minor amendments to the Electricity Industry Participation Code 2010 (“Code”) including:
(a) adding bold to defined terms, or removing bold from terms that are not defined;
(b) placing defined terms into the correct alphabetical order;
(c) removing unnecessary words;
(d) correcting clause headings and contents clauses;
(e) correcting wording where the context is clear that the wrong wording has been used; and
(f) reducing minor obligations on participants.

In accordance with section 39(3) of the Act, the Authority has not prepared and publicised a regulatory statement or consulted on the amendment and the regulatory statement because it is satisfied that the amendments are technical and non-controversial, or there has been adequate prior consultation.

Notice of the Electricity Industry Participation (Time Frames for Invoicing) Code Amendment 2014

Pursuant to section 38(3)(b) of the Electricity Industry Act 2010, the Electricity Authority gives notice of the making of the Electricity Industry Participation (Time Frames for Invoicing) Code Amendment 2014.

The amendment comes into force on 15 May 2014.

The amendment amends clauses 13.206, 14.36 and 14.73 of the Electricity Industry Participation Code 2010 (“Code”) to:
(a) enable the clearing manager to delay the calculation of constrained on amounts in the event that there is a delay to the publication of final prices;
(b) enable the clearing manager to delay the issue of an invoice in the event that it does not receive all information necessary to issue the invoice by the required time;
(c) require the clearing manager to correct invoices where revised reconciliation information is received following the relevant billing period; and
(d) provide for the FTR manager to provide information about the amount of the loss and constraint excess to be paid into the FTR account after the 7th business day of the month if publication of final prices is delayed.
