Proposed Changes to Legislation Relating to Overweight and High-Productivity Motor Vehicles
In accordance with section 161(2) of the Land Transport Act 1998, submissions are sought on proposed changes to Land Transport Rule: Vehicle Dimensions and Mass 2002 and to the Land Transport (Offences and Penalties) Regulations 1999 in relation to overweight and high-productivity motor vehicles.
The purpose of the proposed changes is to remove an imbalance in the penalties incurred by heavy motor vehicles that do not require an overweight permit and are operating overloaded, and those incurred by operators of heavy motor vehicles who hold an overweight permit (either for an indivisible load or a high-productivity motor vehicle) and who breach the conditions of the permit.

The consultation document is also available for viewing at the NZ Transport Agency’s National Office and regional offices.
Groups and individuals who have registered their interest in the Vehicle Dimensions and Mass Rule have been advised of the availability of the consultation document for comment.
Submissions close at 5.00pm on Monday 7 April 2014.

Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register
Pursuant to section 241 of the Land Transport Act 1998 (“the Act”), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:
- who are currently registered in respect of a motor vehicle(s); and
- who have not instructed the Registrar of Motor Vehicles to withhold their details.

| Data Zoo Limited | - To check or confirm the details of the vehicle where our client has an existing security interest in that vehicle. |
- To allow our clients (credit providers) to verify information provided to them by their customers where consent has been given by the customer to perform this verification.
- To assist our clients who have a security interest in that vehicle in the recovery of monies associated with that vehicle.
- To allow our clients who are debt collectors or are agents where a security interest in the vehicle is held in the assisting in the recovery of debts associated with that vehicle. | The authorisation is valid for a period commencing on the date that Data Zoo Limited receives the final decision on its application and ending at midnight on 28 February 2019. |
Conditions
(a) The names and addresses are accessed only by Data Zoo Limited on its own behalf and solely for its own use;
(b) The names and addresses are accessed only for a specified purpose;
(c) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;
(d) Any identified instances of unauthorised access are immediately notified to the NZ Transport Agency (NZTA) and the Privacy Commissioner;
(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for a specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;
(f) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;
(h) The authorisation is valid for a period commencing on the date that Data Zoo Limited receives the final decision on its application and ending at midnight on 28 February 2019; and
(i) The terms and conditions, if any, imposed by the NZTA for access to Motor Vehicle Register information.
