Notice of Meeting of Creditors
Notice is hereby given that the liquidators intend to call a meeting of creditors of the above-named company to be held at KPMG Centre, 18 Viaduct Harbour Avenue, Auckland, on 12 December 2014 at 10.00am.
The purpose of the meeting is to:
i. decide whether to confirm the appointment of Vivian Judith Fatupaito and Shaun Neil Adams as liquidators of the company or to appoint another liquidator in their place;
ii. decide whether to appoint a liquidation committee, under section 315 of the Companies Act 1993, to act with the liquidators;
iii. determine whether to pass a resolution for the purposes of section 258(1)(b) of the Companies Act 1993 setting out the views of creditors; and
iv. deal with any other business that might properly be brought before the meeting.
A creditor may exercise the right to vote either by being present in person, by proxy or postal vote.
Notice of appointment of a proxy must be signed by the creditor and delivered to the liquidator not less than two working days before the start of the meeting.
Creditor claim forms, voting papers and proxy forms must be lodged by 10.00am on 10 December 2014 by email to insolvency@kpmg.co.nz or by post to KPMG Centre, 18 Viaduct Harbour Avenue, Auckland 1010. Postal Address: PO Box 1584, Shortland Street, Auckland 1140.
