The Authorised Futures Dealers (CMC Markets NZ Limited) Notice 2011 Amendment Notice 2014

Pursuant to section 38 of the Securities Markets Act 1988, the Financial Markets Authority gives the following notice.

Notice

  1. Title—This notice is The Authorised Futures Dealers (CMC Markets NZ Limited) Notice 2011 Amendment Notice 2014.

  2. Commencement—This notice comes into force on its notification in the New Zealand Gazette.

  3. Principal notice—This notice amends The Authorised Futures Dealers (CMC Markets NZ Limited) Notice 2011* (“principal notice”).

  4. Renewal of principal notice—Clause 1(3) of the principal notice is amended by deleting

"31 October 2014"

and replacing it with

"29 November 2014".

Electricity (Safety) Regulations 2010

Electricity Regulations (Prohibited Electrical Appliances – Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice (No. 2) 2014

Pursuant to Regulation 87 of the Electricity (Safety) Regulations 2010 (“Regulations”), I, Mark Stephen Wogan, Manager, Energy Safety, WorkSafe New Zealand, give the following notice.

Notice

  1. Short title and commencement—(1) This notice is the Electricity Regulations (Prohibited Electrical Appliances – Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice (No. 2) 2014.

(2) This notice replaces and consequentially revokes the Electricity Regulations (Prohibited Electrical Appliances – Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice 2014, published in the New Zealand Gazette, 26 June 2014, No. 68, page 1927.

(3) This prohibition is to take effect on and from the date following the date of publication of this notice in the New Zealand Gazette.

  1. Prohibited equipment—(1) The sale, including offer to sell, and use, including installation, of the following electrical appliances, is prohibited: All units of “Goldair”-branded wall-mounted fan heaters – Model 3109.

(2) The sale, including offer to sell, of the following electrical appliances, is prohibited: All units of the “Goldair”-branded wall-mounted fan heaters – Model 3108.

(3) The use, including installation, of the following electrical appliances, is prohibited: All units of the “Goldair”-branded wall-mounted fan heaters – Model 3108, except that the prohibition on use does not apply to:

(a) units manufactured after 1 January 2008;

(b) units that on 27 June 2014 had been installed so they are connected directly to the fixed wiring of an installation without connection via the connector block situated on the heater mounting plate.

(4) The appliances prohibited in paragraphs 2(1) to (3) above are, for the purposes of this notice, referred to as the “prohibited appliances”.

  1. Description—(1) The prohibited appliances to which this notice applies are products that are used primarily in bathrooms and are intended to be wall mounted, further described below.

(2) The prohibited appliances have been sold nationally by various electrical retail outlets, most likely prior to 2010. The prohibited appliances may also have been available elsewhere including second-hand in New Zealand.

(3) The prohibited appliances have known markings that include:

(a) in the case of Goldair 3108 – “Goldair”, “Model 3108”, “220-240V 50Hz”, “1000/2000-1200/2400 W”, “DO NOT IMMERSE”, “DO NOT COVER”, and includes the Class II double insulation symbol;

(b) in the case of Goldair Model 3109 – “Goldair”, “Model No. 3109”, “230-240Va.c.- 50Hz”, “IP22”, “Wattage:2400W”, “DO NOT IMMERSE”, “DO NOT COVER”, and includes the Class II double insulation symbol.

(4) The prohibited appliances may also have a four digit code on the rating label or on a separate label on the underside of which the first two digits denote the week of the year it was manufactured and the second two digits denote the year it was manufactured. For example, for the Goldair Model 3108 prohibited appliances, the four digit code ends with “00”, “01”, “02”, “03”, “04”, “05”, “06” or “07”.

(5) The approximate overall dimensions of the prohibited appliances are in each case: 23.5 x 23.5 x 13.5 cm.
