Land Transfer Act Notice

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 16 November 2014, the Register will be updated to record the easement as redundant.

Applicant: Queenstown Gateway (5M) Limited, c/o Burton & Co, Solicitors, PO Box 8889, Symonds Street, Auckland 1150.

Easement: Right to convey water marked “G”, “V”, “H” and “GA” on DP 468142 originally marked “B” on DP 22121 comprised in Computer Freehold Registers 627614 and 627620 (servient tenements) in favour of Computer Freehold Registers 648131, 644265–644268, 51376, 645666, 625251, 6942, 6943, 6945–6949, OT14D/211, OT17A/471, OT19A/1149, OT19B/435, OT19B/436, OT19B/442 and OT19B/577 (dominant tenements) specified in Easement Certificate 797454.16 registered on 5 February 1992.

Circumstances: The dominant tenements have become separated from the servient tenements due to the fact that there are no pipelines located in the easement areas and no longer benefit the dominant tenements as the pipelines have been removed by the Queenstown Lakes District Council at the time the public water reticulation was implemented.
