Ngāti Kōata, Ngāti Rārua, Ngāti Tama ki Te Tau Ihu, and Te Ātiawa o Te Waka-a-Māui Claims Settlement Act 2014
Notification of He Uhi Takai Overlay Classification and Protection Principles—French Pass Scenic Reserve
Pursuant to section 65(1)(a) of the Ngāti Kōata, Ngāti Rārua, Ngāti Tama ki Te Tau Ihu, and Te Ātiawa o Te Waka-a-Māui Claims Settlement Act 2014, the Minister of Conservation hereby notifies that the area described in the Schedule hereto has been declared to be subject to an overlay classification known as he uhi takai by section 57 of the Act.
The provisions of the Act which relate to he uhi takai are sections 56–74.
Pursuant to section 65(1)(b) of the Act, the Minister hereby notifies that the following protection principles are directed at the Minister of Conservation avoiding harm to, or the diminishing of, the Ngāti Kōata iwi/hapu values related to Anaru / part of French Pass Scenic Reserve:
(a) Protection of and respect for wāhi tapu, indigenous flora and fauna and the wider environment within Anaru / part of French Pass Scenic Reserve;
(b) recognition of the mana, kaitiakitanga, and customary values and tikanga of Ngāti Kōata within Anaru / part of French Pass Scenic Reserve;
(c) recognition of Ngāti Kōata as kaitiaki within Anaru / part of French Pass Scenic Reserve;
(d) respect for Ngāti Kōata tikanga and kawa within Anaru / part of French Pass Scenic Reserve;
(e) encouragement of the respect for the association of Ngāti Kōata with Anaru / part of French Pass Scenic Reserve;
(f) accurate portrayal of the association of Ngāti Kōata within Anaru / part of French Pass Scenic Reserve; and
(g) recognition of the relationship of Ngāti Kōata with the wāhi tapu, wāhi taonga and wāhi whakahirahira.
