(b) there would be a significant cost to replace the metering installations at the Ohaaki power station to comply with the obligation in clause 4(2)(a) of Schedule 10.7 of the Code;
(c) the derivation of submission information from the metering installations by subtraction is as accurate as it would be if it was derived using actual metered data and it was acceptable under the Code in the exact same configuration when the equipment was owned by the grid owner;
(d) the exemption from clause 4(2)(a) of Schedule 10.7 of the Code will allow AccuCal, as the metering equipment provider, to arrange certification of the existing metering installations at this ICP even though the metering configuration currently uses subtraction to determine submission information;
and
(e) the requested exemption will have no impact on any other participant or service provider, and will not affect any other Code provision.

Electricity Industry (Exemption No. 191 (Contact Energy Limited)) Exemption Notice 2013
Pursuant to section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.
Notice
- Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 191 (Contact Energy Limited)) Exemption Notice 2013.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

Exemption—Contact Energy Limited (“Contact”) is exempted from compliance with the obligation in clause 10.24(c) of the Electricity Industry Participation Code 2010 (“Code”), in respect of the metering installations at installation control point 0000032431HR99C.

Term—This exemption expires at the earlier of:
(a) the close of 31 December 2023; and
(b) the completion date of a major upgrade to the Ohaaki substation.
- Reasons for granting the exemption—The reasons for granting this exemption are:
(a) granting the requested exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) there would be a significant cost to replace the metering installations at the Ohaaki power station to comply with the obligation in clause 10.24(c) of the Code;
(c) the derivation of submission information by subtraction from the metering installations is as accurate as it would be if it was derived using actual metered data, and it was acceptable under the Code in the exact same configuration when the equipment was owned by the grid owner;
(d) the exemption from clause 10.24(c) of the Code will allow Contact to continue to use subtraction to determine submission information, even though the load is no longer directly connected to the grid; and
(e) the requested exemption will have no impact on any other participant or service provider, and will not affect any other Code provision.
