Notice of Intention to Take Land for Use in Connection With a Road—Hitchen Road, Waikato District

Notice is hereby given that the Waikato District Council, under provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto (“the land”).

The land described in the Schedule to this notice is required for the construction of Pokeno Roading Development at McDonald and Hitchen Roads, Pokeno.

The project is required to improve the safety and efficiency of the Pokeno Roading transport network in accordance with the objectives set out in the Waikato District Plan (Franklin Section), in particular the Pokeno Structure Plan.

The Waikato District Council are unable to locate or trace the owner or successors of the property.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Reserves Act 1977

Classification and Vesting of a Reserve

Under the Reserves Act 1977 the Conservator for the Wellington Hawke’s Bay Conservancy of the Department of Conservation classifies the reserve described in the Schedule as a local purpose (soil conservation and river control) reserve, subject to the provisions of the Act, and vests the reserve in the Hawke’s Bay Regional Council in trust for that purpose, subject to conditions of in-stream management methods mitigating adverse impacts on freshwater fish species, and of maintaining public access to the reserve with information to be provided notifying conditions of access and of reserve closure requirements.
