Land Acquired and Land Set Apart for the Functioning Indirectly of a Road—Centennial Drive and Eastern Taupo Arterial, Taupo District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Erin Stephen, Land Information New Zealand:

(a) Pursuant to section 52(4), declares the land described in the First Schedule to this notice to be set apart for the functioning indirectly of a road, subject to section 8 of the Atomic Energy Act 1945, section 3 of the Geothermal Energy Act 1953, sections 6 and 8 of the Mining Act 1971, sections 5 and 261 of the Coal Mines Act 1979, Part IVA of the Conservation Act 1987, section 3 of the Petroleum Act 1937, section 27B of the State-Owned Enterprises Act 1986, Encumbrance B406416.5, geothermal exploitation and electricity right in gross and profit à prendre created by Transfer B406416.4, and remains vested in the Taupo District Council;

(b) Pursuant to section 20, declares, pursuant to an agreement to that fact having been entered into, the land described in the Second Schedule to this notice to be acquired, vested in the Taupo District Council and, pursuant to section 52(4), set apart for the functioning indirectly of a road, subject to section 59 of the Land Act 1948 and geothermal exploitation and electricity right in gross and profit à prendre created by Transfer B607787.2 on the date of publication hereof in the New Zealand Gazette.

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Erin Stephen, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road and shall remain vested in the Taupo District Council;

(b) Pursuant to section 20, and to an agreement to that fact having been entered into, declares the land described in the Second Schedule is acquired for road and shall vest in the Taupo District Council on the date of publication hereof in the New Zealand Gazette.
