Under the Reserves Act 1977, the Community Support Manager for the East Coast Bay of Plenty Conservancy of the Department of Conservation authorises the exchange of that part of the recreation reserve described in the First Schedule for the land described in the Second Schedule.

Notice of Intention to Take Land for Road—
171 Murphys Road, Flat Bush, Auckland

Notice is hereby given that the Auckland Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the First Schedule to this notice as road and take a leasehold interest in the land (“Lease Area”) described in the Second Schedule to this notice for road construction works.

The land is required for road and the Lease Area for temporary occupation during road construction works.

It is intended to use the land to upgrade the Flat Bush School Road/Murphys Road Intersection to widen and upgrade both roads.

It is necessary to take the land and Lease Area to improve safety at the intersection to reduce the number of fatalities at this intersection.

The land use is in accordance with the notice of requirement.

The owners of the land and those persons with a registered interest in it have been served notice of the Auckland Council’s intention to take the land and the Lease Area and have been advised of their rights to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Revocation of the Reservation Over a Reserve and Specifying the Manner of Disposal

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Community Support Manager for the Hamilton Conservancy, Department of Conservation, hereby revokes the reservation as a local purpose (electricity) reserve over the land described in the Schedule and declares that the land may be disposed of by the council on such terms and conditions as the council determines.

Change of Classification of Part of a Reserve

Under the Reserves Act 1977, the Acting Conservator for the Otago Conservancy of the Department of Conservation changes the classification of that part of the reserve described in the Schedule from a recreation reserve to a local purpose (transfer/landfill) reserve, subject to the provisions of the Act.
