Fisheries (Aquaculture Decision – Resource Consent U120470) Notice 2013 (Notice No. MPI 293)

Pursuant to section 186H(2) of the Fisheries Act 1996, the Spatial Allocations Manager, Ministry for Primary Industries (acting under delegated authority), gives the following notice:

1. An aquaculture decision has been made for Resource Consent U120470, Oyster Bay, Squally Cove, Croisilles Harbour – Beleve Limited.

Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 9) 2013 (Notice No. MPI 292)

Pursuant to Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Deputy Director-General – Maori Primary Sector Partnerships at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 9) 2013.

(2) This notice shall come into effect on 29 November 2013.

2. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 6(1).

(2) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(3) Other terms used in this notice have the same meaning as in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

3. Request to cancel appointment—Motakotako Marae, acting for Ngā Hapū o Aotea Moana being representative of tangata whenua who nominated Janeva Marama Thomson as a Kaitiaki for the area/rohe moana, has requested in writing the cancellation of her appointment as a Kaitiaki.

4. Cancellation of appointment—On 15 November 2013, the Minister for Primary Industries cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Janeva Marama Thomson as a Kaitiaki for managing customary food-gathering within the area/rohe moana.

5. Nomination of a Kaitiaki—Motakotako Marae, acting for Ngā Hapū o Aotea Moana, has nominated Tahi-o-Hurae Rangiawha as a replacement Kaitiaki for managing customary food-gathering within the area/rohe moana.

6. Appointment of a Kaitiaki—(1) On 15 November 2013, the Minister for Primary Industries appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, Tahi-o-Hurae Rangiawha as a Kaitiaki for managing customary food-gathering within the area/rohe moana enclosed by a line:

(a) commencing at the mean high-water mark (MHWM) at Matawha Point (at 37°55.2'S and 174°46.5'E); then

(b) proceeding by a straight line in a southerly direction to the MHWM at Kahua Point (at 38°02.1'S and 174°47'E); then

(c) following the line of the MHWM within the estuarine waters of Aotea Harbour to the northern harbour entrance at Potahi Point; then

(d) in a northerly direction along the MHWM to the point of commencement.

(2) The geographical coordinates used in paragraph 6(1)(a)–(d) are stated in terms of the WGS84 datum.

7. Confirmation of tangata whenua—Ngāti Mahanga and Ngāti Whakamarurangi Tainui, as represented in respect of this appointment by Motakotako Marae-Ngā Hapū o Aotea Moana, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Kaitiaki relates.

8. Power to authorise the taking of fisheries resources for customary food-gathering—Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Kaitiaki.

Pursuant to Regulations 9 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Deputy Director-General – Maori Primary Sector Partnerships at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 20) 2013.

(2) This notice shall come into effect on 29 November 2013.

2. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 4(1); and

“mātaitai reserve” means the area described in clause 4(2).
