Electricity Industry Act 2010

Notice of the Electricity Industry Participation (Revocation of Part 16) Code Amendment 2013

1. Pursuant to section 38(3)(b) of the Electricity Industry Act 2010 (“Act”), the Electricity Authority (“Authority”) gives notice of the making of the Electricity Industry Participation (Revocation of Part 16) Code Amendment 2013.

2. The amendment comes into force on 16 December 2013.

3. The amendment revokes Part 16 of the Electricity Industry Participation Code 2010 (“Code”), and other related provisions, that became redundant following the expiry of the agreements for the supply of electricity to the aluminium smelter at Tiwai Point. The agreements that have replaced the expired agreements are not referred to in the Code.

4. In accordance with section 39(3)(a) of the Act, the Authority is satisfied on reasonable grounds that the nature of the amendment is technical and non-controversial. Therefore the Authority has neither prepared and publicised a regulatory statement, nor consulted on the amendment and a regulatory statement.

5. A copy of the amendment and the Code is available on the Authority’s website at
