(d) Where, any four or any five or all six of the Races of a Pick6 are abandoned, or where, prior to the scheduled start time of the first Pick6 race, any of the Pick6 races are abandoned:
(i) Pick6 investments will be refunded
(ii) the amount brought forward from any previous Pick6 shall be carried forward to the next Pick6 as determined by the Board.

4.21 Use of New Zealand race field information
For the purposes of Rules 4.21 to 4.24, a person “uses New Zealand race field information” if the person, whether in New Zealand or elsewhere:
(a) publishes any New Zealand race field information outside New Zealand; or
(b) communicates any New Zealand race field information to any person outside New Zealand; or
(c) acknowledges or confirms any New Zealand race field information communicated to any person outside New Zealand, including acknowledging or confirming the information by accepting, or facilitating the making of, a bet; or
(d) makes any record (such as a betting ticket, statement of account or notice), that contains or refers to any New Zealand race field information, outside New Zealand; or
(e) causes any of the activities referred to in paragraphs (a) to (d) to occur.
4.22 Use of New Zealand race field information restricted
To ensure the proper establishment of a system of racing betting and the proper conduct and operation of racing betting by the Board and to facilitate and promote the New Zealand racing industry, racing betting and to maximise the Board’s profits for the long-term benefit of New Zealand racing, neither a wagering operator nor any person or class of persons prescribed by the Board can use New Zealand race field information unless:
(a) the wagering operator or prescribed person is authorised to undertake such use pursuant to a race field information use approval issued by the Board or the Board’s authorised agent; and
(b) the wagering operator or prescribed person complies with the conditions to which the approval is subject.
4.23 Board may grant race field information use approvals
(a) The Board, or the Board’s authorised agent, can grant approval to a wagering operator or a prescribed person, to use New Zealand race field information (a “race field information use approval”), as the Board’s agent, in respect of that race or class of races if the person has made an application to the Board for approval.
(b) The Board, or the Board’s authorised agent, can impose conditions on a race field information use approval that it grants, being:
(i) a condition that the holder of the approval pays such fee in such manner as specified in the approval; and
(ii) such other conditions as may be specified in the approval in the Board’s sole discretion.
(c) The Board, or the Board’s authorised agent, can cancel or vary the terms of any approval at any time by written notice to the holder of the approval.
(d) Neither the Board nor the Board’s authorised agent will have any liability to any person in respect of the use of New Zealand race field information by a person holding a race field information use approval.
4.24 Applications for race field information use approvals
(a) A person who wishes to use any New Zealand race field information must apply to the Board, or the Board’s authorised agent, for a race field information use approval in respect of the race or class of races to which the use relates.
(b) An application for a race field information use approval (an “approval application”) must be:
(i) made in the manner prescribed by the Board from time to time; and
(ii) accompanied by such information as prescribed by the Board from time to time.
(c) In determining an approval application, the Board must consult with the governing code in respect of the race or class of races in respect of which the approval is sought.
(d) The granting of a race field information use approval does not authorise the holder of the approval to do, or omit to do, any act or thing in relation to a race to be held at any race meeting at a racecourse in New Zealand other than to use the New Zealand race field information to which the approval relates in accordance with the terms of the approval.
These Rules come into force on 1 September 2013.
