Reassessment of Anti-Dumping Duty: Diaries From The People’s Republic of China and Malaysia

Pursuant to section 14(6) of the Dumping and Countervailing Duties Act 1988 (“the Act”), the Associate Minister of Commerce, having carried out a reassessment of the anti-dumping duty applying to imports into New Zealand of diaries from The People’s Republic of China and Malaysia, following the completion of a review under section 14(8) of the Act, and having determined new rates of anti-dumping duty applicable to those goods, gives the following notice.

Notice

Title and commencement—(1) This notice may be cited as the “Reassessment of Anti-Dumping Duty: Diaries from The People’s Republic of China and Malaysia”.

(2) This notice replaces and supersedes all previous notices in relation to the subject goods described below in the First Schedule.

(3) Pursuant to section 17 of the Act, the reassessed anti-dumping duty, set out in the Second Schedule to this notice, shall apply to imports of the goods specified in the First Schedule with effect from the day after the date of this notice.

(4) Pursuant to section 17 of the Act, the reassessed anti-dumping duty, set out in the Third Schedule to this notice, shall apply to imports of the goods specified in the First Schedule with effect from 1 February 2014.

(5) Where the anti-dumping duties imposed as a result of this notice are lower than those previously in place, in accordance with subsection 14(10) of the Act, importers may apply to Customs for a refund of the difference between the anti-dumping duties imposed by this notice and the anti-dumping duty paid from 7 October 2012.

Diaries, with or without covers, excluding: diaries with steel ring binders; and wallplanners.
The goods are currently classified under tariff Item and statistical key 4820.10.00 02J of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Anti-dumping Duty Payable with effect from the day after the date of this Notice**

Chinese Manufacturer/Exporter Rate of Duty

Residual rate of duty (all other exporters) 20%
Malaysian Manufacturer/Exporter Rate of Duty
UPP Paper Industries Sdn Bhd/UP International Sdn Bhd 25%

**Third Schedule*
Anti-dumping Duty Payable with effect from 1 February 2014**

Malaysian Manufacturer/Exporter Rate of Duty
UPA Press Sdn Bhd 37%
Residual rate of duty (all other exporters) 36%

*The duty rates in the Second and Third Schedules are in the form of ad valorem percentage rates which shall be applied to the value for duty of the goods when entered for home consumption.
