Road Realignment—State Highway 3 Devon Road, New Plymouth District
Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Erin Stephen, Land Information New Zealand:
(a) Pursuant to section 114, declares:
(i) The land described in the First Schedule to this notice to be road which, pursuant to section 88(2) of the Government Roading Powers Act 1989, becomes road, limited access road and State highway and shall vest in the Crown,
which has the effect of adding the portions of road described in the Second Schedule to State Highway 3, pursuant to section 5 of the Land Transport Management Act 2003; and
(ii) The land described in the Third Schedule to this notice to be road which shall remain vested in the New Plymouth District Council.
(b) Pursuant to section 20, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Fourth Schedule to this notice is acquired for the functioning indirectly of a road (segregation strip) and shall vest in the Crown;
(c) Pursuant to sections 116 and 117, declares the portions of road adjoining or passing through the land described in the Fifth Schedule to this notice to be stopped and, pursuant to section 52(1), further declares, shall be set apart for the functioning indirectly of a road (segregation strip) and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.
