Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 10) 2013.

(2) This notice shall come into effect on 22 August 2013.

  1. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 4(1).

(2) Terms used in this notice have the same meaning as in the Fisheries (South Island Customary Fishing) Regulations 1999.

  1. Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Awarua, representing the whānau and hapū of Ngāi Tahu Whānau holding manawhenua manamoana over the area/rohe moana and in particular the Ashwell Whānau (as represented by Te Rūnanga o Ngāi Tahu), has nominated Keith Bradshaw, Peter Dawson, James Foggo, Errol Ryan and Terry Ryan as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana for further five-year terms.

  2. Appointment of Tangata Tiaki/Kaitiaki—(1) On 28 July 2013, the Minister for Primary Industries appointed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, Keith Bradshaw, Peter Dawson, James Foggo, Errol Ryan and Terry Ryan as Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana bounded by a line commencing at Kai Aroha Ke sands in Paterson Inlet completely around the area of Te Wehe a Te Wera (The Neck, Stewart Island) to Ka one a Pukerehu (on the ocean side of the sandspit) to a distance of 300 metres offshore returning to the first-mentioned point.

(2) The appointment described in clause 4(1) will expire on 21 August 2018.

  1. Power to authorise the taking of fisheries resources for customary food-gathering—Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

Pursuant to Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director Māori Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

(2) This notice shall come into effect on 22 August 2013.

  1. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 4(1).

(2) Terms used in this notice have the same meaning as in the Fisheries (South Island Customary Fishing) Regulations 1999.

  1.   2. Appointment of Tangata Tiaki/Kaitiaki—(1) On 28 July 2013, the Minister for Primary Industries appointed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, David Bragg and Peter Topi (Topi Whānau) and Elizabeth Wright (Whaitiri Whānau) as Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana around Ruapuke Island bounded by a line starting at point (168°40'E, 46°42.4'S); then in a southerly direction to a point (168°40'E, 46°50'S); then in a westerly direction to a point (168°22.6'E, 46°50'S); then in a northerly direction to a point (168°22.6'E, 46°42.4'S); returning to the first-mentioned point.

(2) The appointments described in clause 4(1) will expire on 21 August 2018.

  1. Notice of Approval Given Pursuant to Section 160(3) of the Crown Entities Act 2004

Pursuant to section 160(3) of the Crown Entities Act 2004, I, Jeremy Salmond, Treasury Solicitor, hereby give notice that on 30 June 2013, The Honourable Simon William English, Minister of Finance, and The Honourable Anthony Boyd Williams Ryall, Minister of Health, gave approval under section 160(1)(b) of the Crown Entities Act 2004, in relation to section 162 of that Act, for the New Zealand Blood Service (NZBS) to enter into credit arrangements, to a maximum total amount of $8.3 million, subject to the following conditions:

(a) NZBS must act in compliance with the NZBS Financial Guidelines Policy; and

(b) NZBS must seek permission from the Minister of Health to borrow more than $3.0 million in relation to any single capital project.

This approval replaces the approval notified in the New Zealand Gazette, 2 July 2009, No. 97, page 2195.
