Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2013 (Notice No. MPI 197)

Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2013.

(2) This notice shall come into effect on 9 August 2013.

  1. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 5(1).

(2) Terms used in this notice have the same meaning as in the Fisheries (Kaimoana Customary Fishing) Regulations 1998 except for “Tangata Kaitiaki” which are local dialect words that have the same meaning as “Tangata Kaitiaki/Tiaki”.

  1. Cancellation of appointment—On 13 July 2013, the Minister for Primary Industries cancelled, under Regulation 10(1) of Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of the late Michael Osborne as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  2. Nomination of Tangata Kaitiaki—The Whanganui River Māori Trust Board, acting for Te Atihaunui a Paparangi, has nominated Beryl Anne Miller as a replacement Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Appointment of Tangata Kaitiaki—(1) On 13 July 2013, the Minister for Primary Industries appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, Beryl Anne Miller as a replacement Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana enclosed by a line:

(a) commencing at the mouth of the Kai Iwi Stream (at 39°52.90'S and 174°53.00'E); then

(b) proceeding in a south-westerly direction to a point on the boundary of the South Island Fisheries Waters (at 40°27.76'S and 174°04.39'E); then

(c) proceeding in a south-easterly direction along the boundary of the South Island Fisheries Waters to a point on the boundary of the South Island Fisheries Waters (at 40°30.14'S and 174°10.35'E); then

(d) proceeding in a south-easterly direction along the boundary of the South Island Fisheries Waters to a point on the boundary of the South Island Fisheries Waters (at 40°36.25'S and 174°25.63'E); then

(e) proceeding in a north-easterly direction to a point on the mean high-water mark (MHWM) at Motukaraka (at 39°59.19'S and 175°02.29'E); then

(f) proceeding along the MHWM in a generally north-westerly direction to a point on the northern bank of the Whanganui River (at 39°56.02'S and 174°57.85'E); then

(g) proceeding along the MHWM in a generally north-westerly direction to the point of commencement.

(2) The geographical coordinates used in paragraphs 5(1)(a)–(g) are stated in terms of the WGS84 datum.

  1. Confirmation of tangata whenua—Te Atihaunui a Paparangi, as represented by the Whanganui River Māori Trust Board, is confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki relates.

  2. Power to authorise the taking of fisheries resources for customary food-gathering—Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources for customary food-gathering.
