Fisheries (Declaration and Notification of Ōkārito Lagoon Mātāitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2012 (No. MPI 12)

Pursuant to Regulations 20 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister for Primary Industries and the Director-General of the Ministry for Primary Industries give the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Declaration and Notification of Ōkārito Lagoon Mātāitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2012.

  2. Commencement—This notice shall come into effect on the 28th day after the date of its notification in the New Zealand Gazette.

  3. Interpretation—In this notice:

    (a) “mātāitai reserve” means the identified traditional fishing ground described in clause 4 of this notice.

    (b) “Tangata Tiaki/Kaitiaki” means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mātāitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.

  4. Declaration of a mātāitai reserve—The Minister for Primary Industries declares a mātāitai reserve over the following fisheries waters enclosed by a line:

    (a) commencing at a point on the mean high water mark (MHWM) approximately 2.6km south-west of the Ōkārito Lagoon entrance at 43°13.92'S and 170°07.96'E; then

    (b) proceeding seaward in a north-westerly direction to a point approximately 100m from the MHWM at 43°13.88'S and 170°07.89'E; then

    (c) proceeding in a north-easterly direction along a line every point of which is 100m from the MHWM to a point offshore from the northern end of the Ōkārito Māori Land Reserve at 43°12.04'S and 170°10.96'E; then

    (d) proceeding inland in a straight line in a south-easterly direction to a point on the MHWM of Ōkārito Lagoon at 43°12.17'S and 170°11.24'E; then

    (e) proceeding along the MHWM of Ōkārito Lagoon and Lake Windermere (but excluding all waterways, tributaries, streams and rivers that flow into or from Ōkārito Lagoon and Lake Windermere) and then proceeding in a south-westerly direction along the MHWM to the point of commencement.

  5. Appointment of Tangata Tiaki/Kaitiaki—The Director-General names Rihari Wallace, Paul Wilson, Helen Rasmussen, Mata Holliday, Brian Cadigan, Robert Wilson and Thomas Rochford as Tangata Tiaki/Kaitiaki for the mātāitai reserve. This appointment is for a term of five years, commencing on the day that this notice comes into effect.

  6. Prohibition on commercial fishing—Commercial fishing within the mātāitai reserve is prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.

  7. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mātāitai reserve. No fishing for customary food gathering purposes may take place in the mātāitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.

Declaration of Special Emergency

(Notice No. MPI 50)

Pursuant to section 49B(2)(a) of the Hazardous Substances and New Organisms Act 1996, I hereby give notice that on 29 July 2012, The Hon David Carter, Minister for Primary Industries, declared an adverse event, the infestation of alligator weed (Alternanthera philoxeroides) found in Ruahorehore Stream in the Waikato region, to be a special emergency until 5.00pm on 29 January 2013.

Social Security Act 1964

Guaranteed Childcare Assistance Payment Programme

Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development establishes and approves the following welfare programme for special assistance.

Programme

  1. Title—This programme is the Guaranteed Childcare Assistance Payment Programme.

  2. Commencement—This programme comes into effect on 20 August 2012.

  3. Purpose—The purpose of this programme is to provide financial assistance towards the costs of early childhood education to help:

    (a) young parents who are receiving young parent payments, or who are the spouses or partners of specified beneficiaries, to comply with their youth activity obligations; and

    (b) young parents who are not beneficiaries to return to, or remain in, courses of secondary instruction.

  4. Interpretation—(1) In this programme, unless the context otherwise requires:

    Act means the Social Security Act 1964

    applicant

    (a) means a person by whom or on whose behalf an application is made for assistance under this programme; and

    (b) where the context requires, includes a person to whom assistance is granted under this programme

    appropriate contracted service provider, in relation to an applicant, means a contracted service provider—

    (a) providing services of the kind referred to in section 123E(a) of the Act to the applicant; or
