Public Works Act 1981

Revocation of a Notice Declaring Land to be Road and Issue of a Fresh Notice

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Graham Roger Williams, Land Information New Zealand, hereby revokes the notice headed "Land Declared Road—Stanley Bay Wharf, Calliope Road, Devonport, Auckland" dated the 17th day of February 2012 and published in the New Zealand Gazette, 3 May 2012, No. 49, page 1416, and issues the following notice as a fresh notice in its place.

Land Declared Road—Stanley Bay Wharf, Calliope Road, Devonport, Auckland

Pursuant to section 52(1)(b) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Graham Roger Williams, Land Information New Zealand, declares the land described in the Schedule to this notice to be road and vested in the Auckland Council on the date of publication hereof in the New Zealand Gazette, subject to the following condition:

Upon Auckland Council declaring the land described in the Schedule as surplus and no longer required for a public work and, subject to Auckland Council discharging any statutory obligation it may have, the land described in the Schedule is to be offered to the Crown (acting through Land Information New Zealand), pursuant to the protection mechanism of Māori interests in surplus Crown-owned land. The protection mechanism is the process administered by the Office of Treaty Settlements whereby surplus land no longer required for a public work can be acquired by the Crown if it is required for the settlement of a Treaty of Waitangi claim in relation to the specific area of the subject land.
