Notice of Intention to Take Land for Road—

State Highway 1 Waiauti Bridge Realignment Project (Manakau South Turn Bay), Horowhenua District

Notice is hereby given that the Crown, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule of this notice (the “land”).

The land is required for construction of the State Highway 1 Waiauti Bridge Realignment Project (Manakau South Turn Bay).

More particularly, the land is required for road.

The project is required to improve safety for right turning vehicles crossing southbound State Highway 1 into Manakau Road.

The owner of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take their land and their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, 5th Floor, District Court Building, 49 Ballance Street, Wellington 6011, or by post to DX SX11154, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires and each objector will be informed of the time and place of the hearing.

Land Declared Road and Segregation Strip—

State Highway 18, Hobsonville, Auckland

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Kerry McPhail, Land Information New Zealand:

(a) Declares the land described in the First Schedule to this notice to be road, pursuant to section 114, which, pursuant to section 5 of the Land Transport Management Act 2003, forms part of State Highway 18 and is vested in the Crown;

(b) Declares the land described in the Second Schedule to this notice to be set apart, pursuant to section 52(1), for the functioning indirectly of a road (segregation strip) and shall remain vested in the Crown;

(c) Declares that, pursuant to an agreement to that effect having been entered into, the land described in the Third Schedule to this notice is acquired, pursuant to section 20(1), for the functioning indirectly of a road (segregation strip) and vested in the Crown on the date of publication hereof in the New Zealand Gazette.
