Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Natasha Pollard, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which shall vest in the Auckland Council on the date of publication hereof in the New Zealand Gazette.

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Natasha Pollard, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which, pursuant to section 5 of the Land Transport Management Act 2003, forms part of State Highway 1 and remains vested in the Crown on the date of publication hereof in the New Zealand Gazette.

Building Restriction Created—State Highway 60, Te Mamaku Drive, Nelson

Pursuant to section 236 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Natasha Pollard, Land Information New Zealand, declares the land described in the Schedule to this notice ("the Servient Land") to be subject to the following restrictions:

1. Unless the prior written approval of the Crown is beforehand obtained;
   1.1 No structure of any kind whatsoever shall be erected on the Servient Land; and
   1.2 No earthworks disturbing the soil of the Servient Land shall be carried out;
   such works referred to in this encumbrance as "the prohibited works".

2. Any person requesting an exception shall submit to the Crown all plans, specifications and scopes of work necessary to assist the Crown to determine whether the prohibited works may adversely affect the structural integrity of the Crown’s batter adjoining State Highway 60 Te Mamaku Drive and the Servient Land (the "batter") or otherwise compromise the operation of State Highway 60.

3. The Crown may exercise its discretion to withhold its approval if it reasonably believes that the prohibited works may adversely affect the structural integrity of the batter or otherwise compromise the operation of State Highway 60.

4. The Crown may require any person requesting an exception to meet its reasonable costs in considering the request.
