Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 1) 2012 (No. F650)

Pursuant to Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Deputy Director-General Māori Primary Sector Partnerships at the Ministry of Agriculture and Forestry (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 1) 2012.

(2) This notice shall come into effect on 20 April 2012.

2. Interpretation—In this notice:

(a) “mahinga mātaitai” are local dialect words that have the same meaning as “customary food-gathering”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

(b) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

(c) “Kaitiaki” means the person or persons appointed under Regulation 9 or 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of mahinga mātaitai within the area/rohe moana.

(d) “area/rohe moana” means the area/rohe moana defined in the Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2010.

3. Request to cancel appointments—The Mahia Māori Committee, acting for the whānau, hapū and marae of Rongomaiwahine, being the tangata whenua who nominated Te Hira Whati and the late Valletta Wairau as Kaitiaki for the area/rohe moana, has requested in writing the cancellation of their appointments as Kaitiaki.

4. Cancellation of appointments—On 15 April 2012, the Minister for Primary Industries cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Te Hira Whati and the late Valletta Wairau as Kaitiaki for managing mahinga mātaitai within the area/rohe moana.
