Animal Welfare Act 1999

Issue of Animal Welfare (Layer Hens) Code of Welfare 2012 (Notice No. MPI 84)

I hereby give notice that, under section 75 of the Animal Welfare Act 1999, the Animal Welfare (Layer Hens) Code of Welfare 2012 is issued on 6 December 2012, being the date it is notified in the New Zealand Gazette, and comes into effect on 7 December 2012, being the day after the date it is notified in the New Zealand Gazette.

I also give notice, under section 76 of the Animal Welfare Act 1999, that on 6 December 2012, the Animal Welfare (Layer Hens) Code of Welfare 2005* is revoked.

The code of welfare is available for inspection free of charge and for purchase at the following address:

Partnership Implementation at the Ministry for Primary Industries

(acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 4) 2012.

(2) This notice shall come into effect on 13 December 2012.

  1. Interpretation—(1) In this notice:

“area/rohe moana” means the area described in clause 4.

(2) Terms used in this notice have the same meaning as in the Fisheries (South Island Customary Fishing) Regulations 1999.

  1. Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Taumutu, representing the whānau and hapū of Ngāti Tahu Whānau holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāti Tahu), has nominated Donald Brown, David Perenara-O’Connell, Fiona Musson (now known as Fiona Sloan) and Malcolm Wards as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana described in clause 4 below for further five-year terms.

  2. Appointment of Tangata Tiaki/Kaitiaki—On 23 October 2012, the Minister for Primary Industries confirmed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Donald Brown, David Perenara-O’Connell, Fiona Sloan (née Musson) and Malcolm Wards as Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana from the northern bank of the Hakatere River following the coast to Ounu Hau Point at Pōhatu. The area includes Te Waihora–Lake Ellesmere (defined as Quota Management Area ANG 13 in the Fisheries Act 1996) and its catchments, but excludes Te Wairewa–Lake Forsyth; then due east to the limit of the South Island fisheries waters; then following the boundary of the South Island fisheries waters to a point due east of the Hakatere River; and finally back to the northern bank of the Hakatere River.

(2) The appointments described in clause 4(1) will expire on 12 December 2017.

  1. Power to authorise the taking of fisheries resources for customary food gathering—Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
