Charitable Trusts Act Notices

PRESBYTERIAN SUPPORT EAST COAST

Application for Approval of Scheme Under the Charitable Trusts Act 1957

Take notice that PRESBYTERIAN SUPPORT EAST COAST is making an application to the High Court at Napier, proceeding CIV-2012-441-625, under Part 3 of the Charitable Trusts Act 1957, for the approval of a scheme in relation to the bequest made in the codicil to the will of Edward Durning Holt originally to Presbyterian Social Service Association of Hawke’s Bay and Poverty Bay Incorporated.

The orders sought are:

1. An order under the Charitable Trusts Act 1957 approving a scheme that the bequest by Edward Durning Holt (made in clause 2(iii) of the codicil dated 29 November 1976 to his will dated 12 September 1975, as amended by order of the High Court on or about 20 September 2001) to Presbyterian Support Services – East Coast for the general purposes of its Atawhai Homes at Taradale, shall be used by Presbyterian Support East Coast for the general purposes of its JH Mason Retirement Village at 87 Te Mata Road, Havelock North.

2. The sum of $750.00 shall be paid from the bequest to the Attorney-General in respect of the report of the Attorney-General.

3. The applicant’s costs and disbursements of the proceeding be paid from the bequest.

The application is to be heard in the High Court at Napier on 5 December 2012, at 9.30am.
