Fisheries (Kaimoana Customary Fishing) Notice (No. 6) 2012 (No. MPI 70)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Director Māori Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 6) 2012.

(2) This notice shall come into effect on 14 September 2012.

2. Interpretation—In this notice:

(a) “whāngai-tai” and “mahinga kai” are local dialect words that have the same meaning as “customary food-gathering”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Tchakat Kitaki” and “Tangata Kaitiaki” are local dialect words that have the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(c) “Tchakat Kitaki” and “Tangata Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of either whāngai-tai or mahinga kai within the area/rohe moana.

(d) “area/rohe moana” means all fisheries waters (including inland waters) enclosed by a line with each point being 200 nautical miles from the mean high-water mark of all islands in the Chatham Islands Group.

3. Nomination of Tchakat Kitaki—The Hokotehi Moriori Trust through the Pā Tangaroa Fisheries Forum, which acts for Moriori and Ngāti Mutunga, has nominated Mahara Gomez and Elaine Goomes as Tchakat Kitaki for managing whāngai-tai within the area/rohe moana.

4. Appointment of Tchakat Kitaki—On 3 September 2012, the Minister for Primary Industries confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Mahara Gomez and Elaine Goomes as Tchakat Kitaki for managing whāngai-tai within the area/rohe moana.

5. Confirmation of tangata whenua—Moriori and Ngāti Mutunga, as represented in terms of these appointments by the Pā Tangaroa Fisheries Forum, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tchakat Kitaki relates.

6. Power to authorise the taking of fisheries resources for whāngai-tai or mahinga kai—Tchakat Kitaki or Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for whāngai-tai or mahinga kai purposes from within the whole or any part of the area/rohe moana. No whāngai-tai or mahinga kai of fisheries resources may take place in the area/rohe moana without an authorisation from either a Tchakat Kitaki or a Tangata Kaitiaki.

“area/rohe moana” means the area described in clause 4(1).

(2) Terms used in this notice have the same meaning as in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

Nomination of Tangata Kaitiaki/Tiaki—Kahungunu ki Te Matau a Māui, acting for Ahuriri (Napier) and Heretaunga (Hastings) Marae and Hapū, has nominated Mane Hapeta Adams, Charlotte Baker, Walter Broadman, Karauna Brown, Shona Chadwick, Peter Eden, Daniel Gray, Owen Jerry Hapuku, Te Ariki Manihera Henderson, Garry Huata, Tama Huata, Maia Kaukau, Jenny Mauger, Thomas Mulligan, Jillian Munro, Lindsay Gordon Paku, James Robin, Rangi Spooner, Charles Tiare Taurima, Trevor Taurima (Snr), Ropata Te Kuru, Ruka Waapu, Richard Rihimoana Pongo Waerea, Whakamoraro Walker and John Wano, as well as the chairperson of Mihiroa, Te Awhina, Timikara and Wharerangi Marae as Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana described in clause 4(1).

(a) commencing at a point on the mean high water mark (MHWM) on the south-eastern side of the Port of Napier near Bluff Hill (at 39°28.90'S and 176°55.20'E); then

(b) proceeding in a north-easterly direction to a point offshore (at 39°26.90'S and 177°09.60'E); then

(c) proceeding due east to the point where the 36°26.90'S intersects with the boundary of the exclusive economic zone (EEZ); then

(d) proceeding in a southerly direction along the boundary of the EEZ to the point where the 39°38.60'S parallel intersects with the boundary of the EEZ; then
