provide protection against the overloading of cables or a person suffering serious harm.

  1. Reasons for prohibition—The prohibited fittings are, or may be, electrically unsafe, as defined in Regulation 5 of the Electricity (Safety) Regulations 2010, in that:
  • the use of the prohibited fittings poses a significant risk that property may suffer serious damage as a result of fire arising from a current being able to flow through a conductor that exceeds the rating of that conductor; and

  • the installation of the prohibited fittings downstream from a residual current device (RCD) and/or a circuit protection system may compromise the operation of these protection devices resulting in significant risk that a person may suffer serious harm.

Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

This notice prescribes that, pursuant to Regulation 87 of the Electricity (Safety) Regulations 2010, the manufacture, importation, sale (including an offer to sell), and use (including installation) of any inverter fitted with a lead and plug to allow electricity to be supplied into an electrical installation through a socket outlet of that installation. This notice comes into effect on the day following its notification in the New Zealand Gazette.

Notice of Direction to Appoint a Limited Statutory Manager for the Board of Trustees of Bay of Islands College (8)

Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for the Bay of Islands College Board of Trustees.

The following functions, powers and duties of the board are to be vested in a limited statutory manager:

  • All functions, powers and duties of the board as an employer;

  • all functions, powers and duties of the board to manage communications relating to engaging effectively with parents, whānau and community; and

  • all functions, powers and duties of the board to establish procedures and processes for the investigation and resolution of complaints to the board.

A limited statutory manager may also advise the board on policy and procedures development so the board ensures there is a safe and inclusive school culture.

This notice takes effect on the day of publication.

Changes to the Domestic Student Criteria for Children Who Live Unlawfully in New Zealand

Clause 2 of the Amendments to the Education (Domestic Students) Notice 2010¹ which inserted a new clause (g) in the Education (Domestic Students) Notice 2010² is deleted and the following new clause (g) is inserted in its place:

“(g) A child who is unlawfully in New Zealand and who, on application to the Ministry of Education for enrolment under this category, is confirmed by the Ministry as meeting the following criteria:

(i) The student and the parent³ have been ordinarily resident and living in New Zealand continuously for over six months; and

(ii) Either the student has not been previously enrolled at a registered school or the student’s most recent enrolment at a registered school or other provider within the meaning of section 238D of the Education Act 1989 was as a domestic student; and

(iii) Except for those students listed in subparagraphs (A) and (B) below, the student has not held a student permit or student visa, an interim visa with study conditions, a visitor visa with study conditions, a limited purpose permit granted under the Immigration Act 1987 or a limited visa granted under the Immigration Act 2009:

(A) A student who held a student visa or permit issued under the Immigration Act 1987 and whose most recent enrolment at a registered school was as a domestic student;

(B) A student who held a limited purpose permit issued under the Immigration Act 1987 for the purpose of study while the student’s immigration status was being determined and whose most recent enrolment at a registered school was as a domestic student.”

Supplementary Integration Agreements

Pursuant to section 10 of the Private Schools Conditional Integration Act 1975, notice is given that supplementary integration agreements have been signed between the Minister of Education on behalf of Her Majesty The Queen, acting through the Group Manager, Education, Curriculum and Performance, Ministry of Education, pursuant to delegated authority, and the proprietors of the following schools:

Cornerstone Christian School, Palmerston North (1172).
Tasman Bay Christian School, Nelson (1178).

The said supplementary integration agreements were executed on 23 December 2011.
