  1. Controls on the disposal of stored water dispersible granule or wettable powder containing 750g/kg quintozene—(1) All stocks of stored water dispersible granule or wettable powder containing 750g/kg quintozene must be disposed of within three months of this notice.

(2) Stored water dispersible granule or wettable powder containing 750g/kg quintozene may be disposed of by:

(a) treating the substance using a method that changes the characteristics or composition of the substance so that the substance or any product of such treatment is no longer a hazardous substance; or

(b) exporting the substance from New Zealand as waste for environmentally sound disposal provided that such export complies with the relevant requirements of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal and the OECD Decision C(2001)107 on the Control of Transboundary Movement of Wastes Destined for Recovery Operations.

(3) In subclause (2)(a), treating the substance does not include:

(a) application to or discharge to any environmental medium; or

(b) dilution of the substance with any other substance before discharge into the environment; or

(c) depositing the substance in a landfill or a sewage facility; or

(d) depositing the substance in an incinerator unless in doing so the substance is treated in accordance with subclause (2)(a).

Pursuant to section 21 of the Maori Affairs Restructuring Act 1989, the Chief Executive of the Ministry of Māori Development hereby gives notice as follows.

Notice

  1. This notice may be cited as Māori Land Development Notice, Whangarei 2011, No. 2.

  2. The notice referred to in the First Schedule hereto is in relation to the lands described in the Second Schedule hereto, hereby revoked.

  3. The lands described in the Second Schedule hereto are hereby released from the provisions of Part II of the Maori Affairs Restructuring Act 1989.

Acquiring a Strata Easement Over Land for the Construction and Maintenance of a Retaining Wall and Anchor Supports, Wellington City

Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and sections 20 and 28 of the Public Works Act 1981, Frazer Robert Tweedie, Land and Asset Manager, New Zealand Railways Corporation, pursuant to a power delegated to him, under section 10 of the New Zealand Railways Corporation Act 1981, hereby declares that, pursuant to an agreement having been entered into, a strata easement right of support (for the purposes of construction and maintenance of a retaining wall and anchor supports) in gross in perpetuity and having the rights and powers set out in the Second Schedule is hereby acquired over the land described in the First Schedule and shall vest in the Crown for railway purposes on the date of publication of this notice hereof in the New Zealand Gazette.

Second Schedule

Terms and Conditions of Strata Easement

  1. The Crown shall have the right to lay, place, maintain and replace ground anchors and associated equipment in the Easement Land for the purpose of securing a retaining wall.

  2. In order to lay, place, maintain and replace ground anchors and associated equipment, the Crown shall have the right for its servants, agents and workmen with any tools, implements, machinery or other equipment reasonably necessary to enter the Easement Land for the purpose.
