Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2011 (No. F589)

Pursuant to Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Fisheries Manager Customary at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2011.

(2) This notice shall come into effect on 27 May 2011.

  1. Interpretation—In this notice:

    (a) “customary food-gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

    (b) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

    (c) “Kaitiaki” means the person or persons appointed under Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within an area/rohe moana;

    (d) “kai moana” are local dialect words that have the same meaning as “fisheries resources”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

    (e) “area/rohe moana” means an area described by a line beginning on the coastline three kilometres north-east of the mouth of the Pahaoa River (41°23.1’S 175°45.2’E), then due south to a point on the South Island fisheries waters boundary (42°18.9’S 175°45.2’E), then generally north-west following the South Island fisheries waters boundary to a point (41°39.0’S 174°58.0’E), then generally north to a point on the coastline at Windy Point (41°24.0’S 174°59.2’E), then generally east along the coastline to the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

  2. Request to cancel appointments—Ngāti Hinewaka me ona Kārangaranga, being representative of tangata whenua who nominated June Robinson, Ross Ward and the late Whare Grey Te Maari as Kaitiaki for the area/rohe moana, has requested in writing the cancellation of their appointment as Kaitiaki.

  3. Cancellation of appointments—On 18 May 2011, the Minister of Fisheries and Aquaculture cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of June Robinson, Ross Ward and the late Whare Grey Te Maari as Kaitiaki for managing customary food-gathering within the area/rohe moana.

  4. Nomination of Kaitiaki—Ngāti Hinewaka me ona Kārangaranga has nominated David McKinley, Jason Morris and Ani Te Whaiti as replacement Kaitiaki for managing customary food-gathering within the area/rohe moana.

  5. Appointment of Kaitiaki—On 18 May 2011, the Minister of Fisheries and Aquaculture appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, David McKinley, Jason Morris and Ani Te Whaiti as replacement Kaitiaki for managing customary food-gathering within the area/rohe moana.

  6. Confirmation of tangata whenua—Ngāti Hinewaka me ona Kārangaranga is confirmed as the tangata whenua of the area/rohe moana to which the appointment of Kaitiaki relates.

  7. Power to authorise the taking of kai moana for customary food-gathering—Kaitiaki appointed for the area/rohe moana may authorise any individual to take kai moana, managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of kai moana may take place in the area/rohe moana without an authorisation from a Kaitiaki.

Fisheries (South Island Customary Fishing) Regulations 1999

Pursuant to Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Fisheries Manager Customary at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 4) 2011.

(2) This notice shall come into effect on 27 May 2011.

  1. Interpretation—In this notice:

    (a) “customary food-gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999;

    (b) “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana;

    (c) “area/rohe moana” means the area from the Clarence River to the Hurunui River, extending seaward from each point in an easterly direction to the limit of the South Island fisheries waters (as defined in Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999), as well as inland to the boundaries defined for Te Rūnanga o Kaikōura in Te Rūnanga o Ngāi Tahu Act 1996.

  2. Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Kaikōura, being representative of tangata whenua who hold manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Darren Kerei Keepa and Sara Watson as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Appointment of Tangata Tiaki/Kaitiaki—On 10 May 2011, the Minister of Fisheries and Aquaculture confirmed, under Regulation 9(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Darren Kerei Keepa and Sara Watson as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana. The appointments are for five-year terms and will therefore expire on 26 May 2016.
