Social Security Act 1964

Earthquake Job Loss Cover Amendment 2011

Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development and Employment makes the following instrument.

Instrument

  1. Title—This instrument is the Earthquake Job Loss Cover Amendment 2011.

  2. Commencement—This instrument comes into effect on 4 April 2011.

  3. Principal programme amended—This instrument amends the Earthquake Job Loss Cover Programme (as established and approved on 1 March 2011).*

  4. New clause 10 substituted—Clause 10 is revoked and the following clause substituted:

“10 Commencement of job loss cover—Earthquake job loss cover commences:

(a) for an applicant who applied for earthquake job loss cover before 4 April 2011, on 22 February 2011; or

(b) for an applicant (not being an applicant to whom paragraph (a) applies) who was employed by an employer that was receiving Earthquake Support Subsidy after 1 March 2011 and whose employment has been terminated by that employer after that date and before 18 April 2011, on the day after the date on which Earthquake Support Subsidy payments in respect of the applicant ended; or

(c) for an applicant (not being an applicant to whom paragraph (a) applies) who was employed by an employer that was not receiving the Earthquake Support Subsidy after 1 March 2011 and whose employment has been terminated by that employer after that date and before 18 April 2011, on the day after the date on which that employment was terminated.”

  1. Ending of job loss cover—Clause 11(1)(a) is amended by omitting

“six”

and substituting

“eight”.

Explanatory Note

This note is not part of the programme, but is intended to indicate its general effect.

This instrument amends the Earthquake Job Loss Cover Programme:

  • so that earthquake job loss cover, applied for on or after 4 April 2011 by a person whose employment has been terminated after 1 March 2011 by an employer who received the Earthquake Support Subsidy, commences on the day after the date on which Earthquake Support Subsidy payments in respect of the person ended;

  • so that earthquake job loss cover, applied for on or after 4 April 2011 by a person whose employment has been terminated after 1 March 2011 by an employer who did not receive the Earthquake Support Subsidy, commences on the day after the date on which the person’s employment terminated;

  • to extend the period for which earthquake job loss cover may be paid under the programme by two weeks.

Individual Support Payments Programme

Pursuant to sections 124(1)(d) and 5 of the Social Security Act 1964, the Minister for Social Development and Employment establishes and approves the following welfare programme for special assistance.

Programme

  1. Title—This programme is the Individual Support Payments Programme.

  2. Commencement—This programme comes into effect on the day after the date on which it is established and approved.

  3. Expiry—This programme expires on the close of 31 August 2011.

  4. Purpose—The purpose of this programme is to provide short-term special assistance to certain people who have lost employment or self-employment arising from the 22 February 2011 aftershock and who are receiving a specified benefit under the Act.

  5. Interpretation—(1) In this programme, unless the context otherwise requires:

22 February aftershock means the aftershock of the Canterbury earthquake that occurred at 12.51pm on 22 February 2011

Act means the Social Security Act 1964.
