Purpose

• To identify persons registered in respect of motor vehicles that have been involved in accidents causing damage to the property of Fraser Macandrew Ryan Limited’s network utility company client.
• To confirm names and addresses of customers of Fraser Macandrew Ryan Limited’s motor vehicle insurer client only, for the purpose of validating insurance claims.

Term

1 May 2011 to 30 April 2016 inclusive

Conditions

(a) The names and addresses are accessed only for a specified purpose;

(b) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;

(c) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;

(d) Before being permitted access to the Motor Vehicle Register under section 241 of the Act, all new staff must receive training that emphasises that such access must only be for a specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;

(e) Access must be restricted solely to members of staff for whom authorised access is essential for achieving a specified purpose;

(f) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;

(g) A new application for section 241 authorisation must be made if Fraser Macandrew Ryan Limited fundamentally changes its governance or structure; and

Authorised Access to Certain Names and Addresses held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 (“the Act”), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:

• who are currently registered in respect of a motor vehicle(s); and
• who have not instructed the Registrar of Motor Vehicles to withhold their details.

Motorweb Services Limited (Motorweb)

Purpose

(a) To obtain name and address details in respect of a vehicle where the authorised business user has a security interest in the vehicle.

(b) To provide reminder notification of upcoming expiry of vehicle certificates, warrants of fitness and licences to customers of the authorised business users only.

(c) For an authorised business user who is a repossession agent or debt collector, to assist in locating a motor vehicle, or recovering a debt in relation to a motor vehicle, where the repossession agent or debt collector has, or has been engaged as an agent by a person who has, a security interest in the vehicle.

(d) For an authorised business user who holds an authorisation under section 241 of the Act, or who has a right to such information for one of the purposes of the Motor Vehicle Register set out in section 235 of the Act, information may be provided for the purposes for which the authorised business user is allowed access.
