The notice of direction to appoint a limited statutory manager for the board of trustees of Whangaroa College (as published in the New Zealand Gazette, 8 October 2009, No. 148, page 3583) is hereby revoked under section 78M(7) of the Education Act 1989.

School Establishment

Pursuant to section 146 of the Education Act 1989, I hereby establish a Year 1–8 school, to be known as Hobsonville Point Primary School, at Clark Road, Hobsonville Point, Waitakere.

The school will open for instruction at all year levels in term one, 2013.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (South Island Customary Fishing) Notice (No. 3) 2011 (No. F577)

Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Fisheries Manager Customary at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 3) 2011.

(2) This notice shall come into effect on 11 March 2011.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999;

(b) “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulations 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana;

(c) “area/rohe moana” means:

(i) the area from the north bank of the Pouerua River to the Hokitika River; and

(ii) the area from the Hokitika River to the Kawatiri/Buller River; and

(iii) the area from the Kawatiri/Buller River to Kahurangi Point.

The areas extend seaward to the limit of the “South Island fisheries waters” as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, and, in terms of sub-area:

(A) in terms of sub-area 2(c)(i), inland to boundaries defined for Te Rūnanga o Makāwhio and Te Rūnaka o Kāti Waewae under Te Rūnanga o Ngāi Tahu Act 1996; and

(B) in terms of sub-areas 2(c)(ii) and (iii), inland to boundaries defined for Te Rūnaka o Kāti Waewae under Te Rūnanga o Ngāi Tahu Act 1996.

  1. Request to cancel appointment—Te Rūnanga o Ngāti Waewae, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), who nominated Rick Barber as a Tangata Tiaki/Kaitiaki for the area/rohe moana, has requested in writing the cancellation of his appointment as a Tangata Tiaki/Kaitiaki.

  2. Cancellation of appointment—On 7 February 2011, the Minister of Fisheries and Aquaculture cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Rick Barber as a Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Nomination of Tangata Tiaki/Kaitiaki—Te Rūnanga o Ngāti Waewae, representing the whānau and hapū of Ngāi Tahu Whānui holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Francois Tumahai as a replacement Tangata Tiaki/Kaitiaki for the area/rohe moana.

  4. Appointment of Tangata Tiaki/Kaitiaki—On 7 February 2011, the Minister of Fisheries confirmed, under Regulation 10(2) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Francois Tumahai as a Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana. The fixed-term-year appointment will expire on 13 August 2014.

  5. Power to authorise the taking of fisheries resources for customary food-gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
