Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares the land described in the Schedule to this notice to be road and vested in the Auckland Council on the date of publication hereof in the New Zealand Gazette.

Road Realignment—Ngaroto Road, Waipa District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road vested in the Waipa District Council excluding mineral interests reserved by section 5 of the Coal Mines Act 1979 and section 8 of the Mining Act 1971.

(b) Declares the land described in the Second Schedule hereto to be taken, under section 119, and vested in the Waipa District Council.

Easement Acquired for the Oakura Pipeline— Wairau Road and Tasman Parade, Oakura, New Plymouth District

Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easement described in the Second Schedule to this notice is acquired over:

(a) The land of Paul Christopher Barron and Jill Gwendoline Barron (“The First Grantor”); and

(b) The land of Allan Graeme Day and Peta Day (“The Second Grantor”); and

(c) The land of Keith Wilson Coughtrey and Shona Anne Lawn (“The Third Grantor”); and

(d) The land of Elwyn Margaret Beatson as to a one-half share and Raewyn Doris Symes as to a one-half share (“The Fourth Grantor”); and

(e) The land of Ross Lovell Symes, Raewyn Doris Symes and John Heyrick Pease as to a one-half share and Ross Lovell Symes, Raewyn Doris Symes and John Heyrick Pease as to a one-half share (“The Fifth Grantor”); and

(f) The land of Anthony Campbell White, Clare Louise White and RMY Trustees Limited (“The Sixth Grantor”)

(the First, Second, Third, Fourth, Fifth and Sixth Grantors each to be known as “the Owner”), being the land described in the First Schedule to this notice for the purposes of the Oakura Pipeline upon the terms and conditions set out in the Third Schedule to this notice and shall vest in the New Plymouth District Council (“the Council”) as Grantee on the date of publication hereof in the New Zealand Gazette.

A right to drain sewage easement in gross over that part of the Land marked “A”, “B” and “C” on LT 423151, and “A”, “B” and “C” on LT 431575 (“the Servient Land”).

Third Schedule
Easement Rights and Powers and Covenants

1. Together with the additional rights and powers set out in this Schedule, the easement shall contain the rights and powers implied in such easements by the Fourth Schedule to the Land Transfer Regulations 2002 and in the event of any conflict between the implied rights and powers expressly stated, the rights and powers expressly stated shall prevail.

2. The Council may use the easement for all sewerage purposes in accordance with the Local Government Act.
