(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for a specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;
(f) Access must be restricted solely to members of staff for whom authorised access is essential to achieving a specified purpose;
(g) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;
(h) Everyone contacted through names and addresses accessed under this authorisation must, at the first opportunity, be informed of their right to opt out under section 241(7)(b) of the Act, and also that they may request that Inchcape Motors New Zealand Limited immediately remove them from its mailing list so that they will not receive any further marketing or market research-related correspondence; and
(i) The terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.

Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register
Pursuant to section 241 of the Land Transport Act 1998 (“the Act”), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:
- who are currently registered in respect of a motor vehicle(s); and
- who have not instructed the Registrar of Motor Vehicles to withhold their details.
Person Purpose Term
Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) To provide information concerning the location and retrieval of motor vehicles to persons whose vehicles have, at the request of an enforcement authority, been:
(i) recovered, where Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) are on the Police roster of vehicle recovery service operators;
(ii) impounded, where Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) are approved vehicle storage providers for the Police. From the date Rodney Emmett Naylor and Carol Jane Naylor receive the final decision on their application to 30 September 2016 inclusive.
Conditions
(a) The names and addresses are accessed only by Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) solely for their own use;
(b) The names and addresses are accessed only for the specified purpose;
(c) To access the Motor Vehicle Register in connection with vehicle recovery, Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) must hold, and continue to hold, a vehicle recovery service licence issued pursuant to the Land Transport Rule: Operator Licensing 2007;
(d) Rodney Emmett Naylor and Carol Jane Naylor (trading as Hawke’s Bay Towing) must ensure that, in connection with vehicle recovery, a tow authority is completed in every case before name and address details are accessed from the Motor Vehicle Register;
(e) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;
(f) Access must be restricted solely to a centralised location and to members of staff for whom authorised access is essential to achieving the specified purpose;
(g) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;
(h) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;
(i) The names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose;
(j) Records must be kept of the purpose, occasions, and vehicle registration plate numbers whenever name and address details are accessed from the Motor Vehicle Register; and
(k) The terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.
