Notice of Exemption From Maritime Rules: 21.13(1)(b); 31B.10, Table 3; 31C.10, Table 3; 40A.33(2)(e); 40C.52(1), Appendix 3.2, Lifebuoys(2); 46.17(1)(a)
Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

3 from Maritime Rule 21.13(1)(b) – Safe Ship Management Systems – Entry to and conditions to be met in order for ship to remain in Safe Ship Management System – New Zealand Safe Ship Management Certificate issued by the director.

1 from Maritime Rule 31B.10, Table 3 – Crewing and Watchkeeping, Offshore, Coastal and Restricted (Non-Fishing Vessels) – Passenger Vessels – Enclosed area – Passenger vessels operating in the enclosed area must carry at least seafarers holding the minimum required qualifications specified in Table 3 and in the accompanying flow-chart.

1 from Maritime Rule 31C.10, Table 3 – Crewing and Watchkeeping Fishing Vessels – Operating areas – Offshore area – Fishing vessels operating in the offshore area must carry at least seafarers holding the minimum required qualifications specified in Table 3 and the accompanying flow-chart.

1 from Maritime Rule 40A.33(2)(e) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – General Passenger Ships – Machinery – Petrol inboard and outboard engines – Auxiliary outboard engine of sufficient power for safe return to port or safe haven.

1 from Maritime Rule 40C.52(1), Appendix 3.2, Lifebuoys(2) – Design, Construction and Equipment – Non-Passenger Ships that are not SOLAS Ships – Life saving appliances – Life saving appliances are provided in accordance with the requirements of Appendix 3 – Offshore limit ships and coastal limit ships – One lifebuoy on each side of the ship must be fitted with a buoyant lifeline.

1 from Maritime Rule 46.17(1)(a) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length – Inspections – Inspections of hull and external fittings below the waterline with the ship out of the water at intervals not exceeding two years.

Pursuant to section 49 of the Privacy Act 1993, I give notice as follows:

The Credit Reporting Privacy Code 2004 Amendment No. 5:
(a) was issued on 30 September 2011; and
(b) will generally come into force on 1 April 2012, with two transitional clauses coming into force on 1 December 2011. -
Copies of the amendment may be inspected or obtained free of charge from the offices of the Privacy Commissioner, 51–53 Shortland Street, Auckland, and 109–111 Featherston Street, Wellington, or downloaded from the website www.privacy.org.nz

Retirement Villages Act 2003
Proposed Variation to the Retirement Villages Code of Practice 2008
I give notice that, in accordance with section 91 of the Retirement Villages Act 2003, I invite written submissions on proposed variations to the Code of Practice to be received at my office by 5.00pm on Monday 21 November 2011.
The proposed variations to the Code of Practice are to:

Clause 22: Fire and accidental damage – including insurance cover, repair and reinstatement of property and temporary accommodation;

Clause 47: Grounds for termination if the unit is damaged or destroyed through no fault; and
-
Clause 54: Payments due to the resident on termination or end of occupation – including charges.
There are also some proposed additions to the definitions section (clause 2) relating to the issues in the proposed variations.
The proposed variations I am consulting on have been received from:
- The Association of Residents of Retirement Villages (Auckland Region);
- The Retirement Villages Association; and
- The Department of Building and Housing.
This consultation is being undertaken jointly with the Department of Building and Housing.
