3. A person having a claim against the ship or described property, or the proceeds of sale of that ship or property, on which the person intends to proceed to judgment should commence an action to enforce that claim before the date specified in paragraph 2 and, if necessary, apply to the Court to extend the period within which the order of priority of claims will not be determined.

4. If the steps referred to in paragraph 3 are not taken, an order determining the priority of claims against the ship or described property, or the proceeds of sale of that ship or property, may be made without notice to the person claiming against the ship or described property, or the proceeds of sale of that ship or property.

Statement of Export Credit Office Guarantee Given Under the Public Finance Act 1989

Pursuant to section 65ZD(3) of the Public Finance Act 1989, the Minister of Finance makes the following statement:

“On 24 August 2011, the Deputy Secretary, Financial Operations and Head of NZDMO acting for and on behalf of the Honourable Bill English, Minister of Finance on behalf of the Crown, provided a New Zealand Export Credit Office Supplier Credit Guarantee to Sanford Limited to support the export of fish and shellfish to an off-shore buyer. The New Zealand Export Credit Office maximum guarantee liability is USD 8,400,000. A premium, commensurate with the risk, was paid for this Guarantee.”

Hazardous Substances and New Organisms Act 1996

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Protection Authority (EPA) advises that it approved on 22 August 2011, the Code of Practice HSNOCOP 53 version 1.0 Compressed Gas Cylinder Fittings Standards.

This code has been developed by the EPA and provides standards for the design and construction of fittings for compressed gas cylinders.

It is a means of compliance with Regulations 27(1)(f), 27(2)(e), 28(1)(c), 28(2)(d), 28(3)(c), 29(1)(c), 29(2)(d), 30(1)(c), 30(2)(c), 31(d), 32(e), 33(c), 34(1)(c)(iii) and 34(2)(b) of the Hazardous Substances (Compressed Gases) Regulations 2004.
