Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

The operative provisions of this Order come into force on 30 September 2011. This Order replaces the Registered Bank Disclosure Statements (Overseas Incorporated Registered Banks) Order (No 2) 2011.

The main purpose of this Order is to give legal effect to the current versions of material incorporated by reference in reliance on section 81AA and in accordance with Schedule 3 of the Reserve Bank of New Zealand Act 1989.

Minor corrections are also made to clauses 6 and 11 of Schedule 2 and clauses 5 and 8 of Schedule 3 so that disclosures relating to guarantees need only be made if they relate to the New Zealand branch of the registered bank. Two minor corrections are made in clauses 4(1) and 4(3) of Schedule 11.
