Notice of Entry into Possession of Mortgaged Land

In the matter of section 156 of the Property Law Act 2007,
and in the matter of mortgage 6441349.3 (Wellington Land Registry), Identifier WN40B/155 (“the mortgage”),
and in the matter of Hugh Alexander Latimer and Graham Neil Searle

TEA Custodians (Pacific) Limited (now GE Custodians) (“the mortgagee” under the mortgage) hereby gives notice that it has entered into possession of the mortgaged land described below with effect from 28 July 2011.

The description of the mortgaged land is an estate in fee simple containing 2.3600 hectares, more or less, being Lot 1 DP 67513, being the property situated at 345 Makirikiri Road, Marton (also known as 4720 Makirikiri Road, Marton).

On 7 June 2011, FM Custodians Limited, by virtue of memorandum of mortgage 5837540.2 (Wellington Land Registry) and pursuant to subpart 6 of the Property Law Act 2007, first entered into possession of the property situated at Unit 31 and Accessory Units 40, 68, 73–74, 76, 80–81 and ½ share of Accessory Unit 79 at the corner of Tory Street and Courtenay Place, Wellington, being the property comprised and described in certificate of title 279600.

Notice of Receipt of Income From Mortgaged Property

On 21 June 2011, FM Custodians Limited, by virtue of memorandum of mortgage 7715355.1 (Wellington Land Registry) and pursuant to subpart 6 of the Property Law Act 2007, first entered into possession of rents and received income from the property situated at Unit 131, 72 Tory Street, Te Aro, Wellington, being the property comprised and described in certificate of title 360204.
