("the Act") in respect of the designated access service of Telecomโ€™s unbundled bitstream access ("Decision 611"). Decision 611 has since been clarified on a number of occasions.

On 19 February 2010, the Commission commenced a review of the data transmission cost (a component of the UBA price) under section 30R of the Act.

On 3 March 2011, the Commission commenced a second review of the UBA pricing methodology under section 30R of the Act in order to assess the submissions made by the parties as part of the data cost review.

Section 30R of the Act provides that the Commission may, on its own initiative, commence a review, at any time, of all or any of the terms specified in a standard terms determination and requires public notice of the commencement of the review.

Pursuant to section 30R(5)(d) of the Act, the Commission gives public notice that it has released its decision in relation to both of the above section 30R reviews of Decision 611.

Maritime Security Act 2004

Designation of a Port Security Area

Pursuant to section 45 of the Maritime Security Act 2004, I, Catherine Joy Taylor, Director of Maritime New Zealand, hereby designate the following area at CentrePort, Wellington, as a port security area:

(a) That land on Inter-Island Wharf (excluding the existing port security area contained on the eastern boundary), when within any fenced or secured area used to berth cruise or other vessels from time to time.

(b) For the avoidance of doubt this Gazette Notice does not affect the status of the port security area on the eastern side of the Inter-Island Wharf designated a port security area on 20 August 2004.

(c) This designation takes effect from 4 August 2011.
