(f) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all LemonCheck Limited staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;

(g) Access by LemonCheck Limited staff must be restricted solely to those members of staff for whom authorised access is essential;

(h) The names and addresses obtained under this authorisation by authorised business users shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose;

(i) LemonCheck Limited must provide an annual report to the Secretary for Transport on LemonCheck Limited’s compliance with the conditions set out in this notice by 1 July each year beginning with 1 July 2012 (this requirement may be incorporated into the company’s usual audit practices); and

(j) The terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register Information.

Notice of Direction to Require Screening†

Pursuant to section 77B(1) of the Civil Aviation Act 1990, I direct the Aviation Security Service to perform the functions listed in the Schedule hereto, effective from 1 August 2011.

This Direction replaces the previous Direction (SR 2002/310) published in the New Zealand Gazette, 26 September 2002, No. 143, page 3780 (notice au6450), which is hereby rescinded.

Schedule

I direct the Aviation Security Service:

  • in accordance with section 77B(1)(a)(i) and (ii) of the Civil Aviation Act 1990, to screen:

    • all persons intending to travel as a passenger or crew member, and any carry on baggage to be carried, on an aircraft with a maximum certificated passenger* seating capacity of more than ninety seats, being operated as an air transport operation within New Zealand, unless the Director is satisfied that such screening is unnecessary in a particular case.
  • in accordance with section 77B(1)(b)(i) and (ii) of the Civil Aviation Act 1990 to undertake reasonable searches, if necessary, of:

    • all persons intending to travel as a passenger or crew member, and any carry on baggage to be carried, on an aircraft with a maximum certificated passenger* seating capacity of more than ninety seats, being operated as an air transport operation within New Zealand, unless the Director is satisfied that such screening is unnecessary in a particular case.

*Maximum certificated passenger seating capacity for the purpose of this Direction means the maximum passenger seating capacity approved by the relevant Type Certificate Data Sheet for a particular aircraft type.

This Direction is available for inspection at the main office of the Civil Aviation Authority of New Zealand, and may be downloaded from the CAA website www.caa.govt.nz
