Officials estimate that in CP1, 60 million NZUs will be allocated to post-1989 forest land owners (based on the mid range projection of 67 percent uptake); 17 million NZUs will be issued to pre-1990 forest land owners; 11 million NZUs will be issued to emissions intensive, trade exposed industry; 700,000 NZUs will be allocated to the fishing sector; 4 million will be issued to those carrying out removal activities, or other non-forestry related activities; and 1 million units will be granted to parties to meet the Crown’s obligations under the two Negotiated Greenhouse Gas Agreements.

Officials will monitor the balance of units closely to ensure a further issuance, or cancellation of units in 2012 can occur to maintain the proper functioning of the NZ ETS.

Under section 86F of the Climate Change Response Act, by the end of the true-up period under the Kyoto Protocol (which will be in 2015 for CP1), the Crown holds a number of Kyoto units equal to the number of NZUs issued into a Crown holding account during CP1, subject to specified exemptions. The projected net flow of units to the Government under the scheme is such that obligation to back issued NZUs with Kyoto units means the Crown will have a deficit of approximately 30 million units.

In addition, careful monitoring of the Commitment Period Reserve between now and 2012, and the Crown’s position in 2012 to ensure that the Government’s obligations are met at least cost, is required.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (Declaration of Wairewa/Lake Forsyth Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (No. F516)

Pursuant to Regulations 20, 21 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries and Aquaculture hereby gives the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Declaration of Wairewa/Lake Forsyth Mātaitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010.

  2. Commencement—This notice shall come into effect on the 28th day after the date of its notification in the New Zealand Gazette.

  3. Interpretation—In this notice:
    (a) “mātaitai reserve” means the identified traditional fishing ground described in clause 4 of this notice.
    (b) “Tangata Tiaki/Kaitiaki” means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mātaitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.

  4. Declaration of a mātaitai reserve—The Minister of Fisheries and Aquaculture hereby declares a mātaitai reserve over all fisheries waters of Lake Forsyth and outlet that flows into the sea and the Takiritawai River that flows into the northern end of Lake Forsyth, excluding any other river or stream or tributary that flows into or from any of these fisheries waters.

  5. Appointment of Tangata Tiaki/Kaitiaki—Charlie Zimmerman, Iaean Cranwell, John Boyles, Rei Simon, Robin Wybrow and Theo Bunker are hereby appointed as Tangata Tiaki/Kaitiaki for the above mātaitai reserve. The appointment is for a term of five years.

  6. Commercial fishing prohibited area—Commercial fishing within the above mātaitai reserve is hereby prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.

  7. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mātaitai reserve. No fishing for customary food gathering purposes may take place in the mātaitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.
