Cancellation of appointment—On 28 April 2010, the Minister of Fisheries and Aquaculture cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Hayden Henry as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

Nomination of Tangata Kaitiaki—The Tauranga Moana Iwi Customary Fisheries Working Committee, on behalf of Ngāiterangi, Ngāti Ranginui and Ngāti Pukenga, has nominated Wiremu Smith as a replacement Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana for Hungahungatoroa Marae, and B. J. (Brian Johnson) Williams as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana for Opureora Marae.

Appointment of Tangata Kaitiaki—On 28 April 2010, the Minister of Fisheries and Aquaculture appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, Wiremu Smith as a replacement Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana and confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of B. J. (Brian Johnson) Williams as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.

Fisheries (Kaimoana Customary Fishing) Notice (No. 9) 2010 (No. F536)
Pursuant to Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Deputy Chief Executive Fisheries Management at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1998) gives the following notice.
Notice
- Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 9) 2010.
(2) This notice shall come into effect on 4 June 2010.
- Interpretation—In this notice:
(a) “customary food-gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) “Tangata Kaitiaki/Tiaki” means the person or persons appointed under Regulation 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.
(c) “area/rohe moana” means an area beginning on the coastline at Huarau (39°53.1′S and 176°58.1′E); then proceeding generally south-west following the coastline to the mouth of the Ouepoto Stream (40°08.9′S and 176°50.7′E); then proceeding generally south-east for 200 nautical miles to a point (41°25.0′S and 178°32.0′W);
then proceeding generally north-east to a point (41°09.0′S and 178°22.0′W); then proceeding generally north-west for 200 nautical miles to the point of commencement.

Nomination of Tangata Kaitiaki/Tiaki—The Kairakau Lands Trust has nominated Stella August as a Tangata Kaitiaki/Tiaki for managing customary food-gathering with the area/rohe moana.

Appointment of Tangata Kaitiaki/Tiaki—On 26 May 2010, the Minister of Fisheries and Aquaculture appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, Stella August as a Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana.

Confirmation of whenua—The Kairakau Lands Trust is confirmed as the representative of tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki/Tiaki relates.

- Interpretation—In this notice:
(a) “customary food-gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) “Kaitiaki” means the person or persons appointed under Regulations 9 or 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.
(d) “area/rohe moana” means all those waters of the Aotea Harbour and adjacent coastline enclosed in an area bounded by a line commencing at the mean high-water mark at Matawha Point (at 37°55.2′S and 174°46.5′E); then proceeding by a straight line in a southerly direction to the mean high-water mark at Kahua Point (at 38°02.1′S and 174°47′E);
