Māori Land Development Notice
Pursuant to section 21 of the Maori Affairs Restructuring Act 1989, the Chief Executive of the Ministry of Māori Development hereby gives notice as follows.

This notice may be cited as Māori Land Development Notice, Whangarei 2010, No. 5.

The notice referred to in the First Schedule hereto is hereby revoked.

The land described in the Schedule hereto is hereby released from the provisions of Part II of the Maori Affairs Restructuring Act 1989.

A Proclamation
Pursuant to the Public Works Act 1981, I, The Honourable Sir Anand Satyanand, Governor-General of New Zealand, hereby declare:
(a) the land described in the First Schedule to be taken for road; and
(b) the leasehold estate in the land described in the Second Schedule to be taken for temporary occupation during construction of the intersection improvements on the terms contained in the Third Schedule such land and leasehold estate to vest in the Crown on the 14th day after the date of the publication of this Proclamation in the New Zealand Gazette.

Third Schedule
Purpose for which leasehold estate is required
The leasehold estate is required over the land referred to in the Second Schedule (“the Land”) of this notice to allow the Crown to occupy it temporarily (for a period of approximately 14 days) during the construction of intersection improvements at the corner of Peninsula Road and State Highway 6, Frankton, for the construction of replacement boundary fencing.
The replacement fencing is to be a boundary fence of a construction similar to the existing fencing.
Terms of the leasehold estate

The lease will run for a term of two years commencing 14 days after the land in the First Schedule vests in the Crown (the “Term”). Occupation for construction will take place over a period of up to 14 days during the Term.

The permitted use for the lease will be the right for the Crown and its employees, engineers, assistants, consultants, contractors and authorised invitees to enter, re-enter and remain upon the Land at all times, with or without such vehicles, machinery or materials and carry out the construction of a replacement boundary fence and any associated or incidental works (the “Permitted Use”).

During the Term the Crown must give 10 days’ notice in writing that it intends to enter the Land for the purpose of carrying out the Permitted Use.
