Notice of Determination—Section LH 13 of the Income Tax Act 2007

This notice of determination is made under section LH 13 of the Income Tax Act 2007.

I am satisfied that the internal software developments of the Weta Group for the 2008–2009 income year meet the requirements in section LH 13(2)(a) to (c).

I have determined, in accordance with section LH 13(2), that the amount of $4,000,000 is appropriate for the purposes of section LH 1(1) for the Weta Group, for the 2008–2009 income year.

Electricity Governance Regulations 2003

Electricity Governance Regulations (Exemption No. 111 (System Operator)) Exemption Notice 2010

Pursuant to Regulation 194 of the Electricity Governance Regulations 2003, the Electricity Commission (“Commission”) gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 111 (System Operator)) Exemption Notice 2010.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—The System Operator is exempted from compliance with the requirement in Rule 3.33 of Section V of Part G and Schedule G2 of Part G of the Electricity Governance Rules 2003, to provide the values for deficit 6s reserve for an extended contingent event and deficit 60s reserve for an extended contingent event.

  2. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) a rule change that requires the scheduling pricing and dispatch model (“SPD”) to use additional model parameters came into force on 1 May 2010. This change requires changes to SPD and to the reserve management tool (“RMT”);

(b) the System Operator was not able to complete these changes prior to 1 May 2010; and

(c) granting this exemption allows the System Operator time to develop and implement the changes to SPD and RMT necessary to implement the additional model parameters.

  1. Terms and conditions—This exemption is granted on the condition that it will expire on the earlier of:

(a) the date on which the System Operator notifies the Commission that the changes to SPD and RMT, necessary to give effect to the rule change, have been implemented; and

(b) 31 August 2010.

Electricity Governance Regulations (Exemption No. 112 (Clearing Manager)) Exemption Notice 2010

Pursuant to Regulation 194 of the Electricity Governance Regulations 2003, the Electricity Commission (“Commission”) gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 112 (Clearing Manager)) Exemption Notice 2010.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—The Clearing Manager is exempted from compliance with Rules 5.3.1A, 5.3.1B, 5.4, 5.5, 5.7, and 6.3 of Section V of Part G of the Electricity Governance Rules 2003 (“Rules”), to the extent those rules relate to constrained on amounts for ancillary service agents.

  2. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) a rule change that requires the Clearing Manager to calculate constrained on amounts for instantaneous reserve came into force on 1 May 2010. This change also required the System Operator to make changes to its billing systems as the billing system provides data files to and from the Clearing Manager;

(b) the System Operator was not able to complete these changes prior to 1 May 2010; and

(c) granting this exemption allows the Clearing Manager to be compliant with the Rules until the System Operator completes the changes to its billing systems.

  1. Terms and conditions—This exemption is granted on the condition that it expires on the earlier of:

(a) the date on which the System Operator notifies the Commission that the changes to its billing systems, necessary for the Clearing Manager to give effect to Rules 5.3.1A, 5.3.1B, 5.4, 5.5, 5.7, and 6.3 of Section V of Part G of the Rules, have been implemented; and

(b) 31 August 2010.
