Kenneth Peter Brown and Paul Thomas Manning, chartered accountants of Tauranga, were, on 20 January 2010, appointed as joint receivers and managers of the property of TOPSCO INTERNATIONAL NZ LIMITED under the powers contained in a general security agreement dated the 29th day of June 2009, which property consists of all present and after-acquired personal property.

Michael Joseph Patrick Ryan and Ian Charles Francis, of Taylor Woodings, Level 6, 30 The Esplanade, Perth, Australia, and Paul Graham Sargison, of Gerry Rea Partners, Level 7, 59 High Street, Auckland, all insolvency practitioners, hereby give notice that on 15 January 2010 they were appointed receivers of certain property of AUSTRAL PACIFIC ENERGY (NZ) LIMITED (“the company”), under the powers contained in instruments dated the 18th day of December 2006.

The receivers have been appointed in respect of:

(a) all of the companies’ shareholdings in Totara Energy Limited, Puka Energy Limited, Hebe Energy Limited, Matai Energy Limited, Millennium Oil & Gas Limited, Rata Energy Limited and Titoki Energy Limited (“the companies”); and

(b) all debts owed from time to time by the companies to the company.

(a) all royalties received or to be received by the company and all other rights of the company pursuant to an overriding royalty agreement between the company as grantee and Cheal Petroleum Limited as grantor dated the 31st day of July 2009; and

(b) all residual rights of the company under an agreement for sale and purchase of assets between Austral Pacific Energy (NZ) Limited (in receivership), the company as vendor, and Cheal Petroleum Limited as purchaser dated the 31st day of July 2009.
