Land Transfer Act Notice

The owners of land adjoining the bank of the Takahiwai Stream in the District of Whangarei has applied to me to bring part of the dry bed of the Takahiwai Stream under the provisions of the Land Transfer Act 1952 and issue a Computer Freehold Register for it in their name.

Land Registration District: North Auckland.

Application No.: 8279551.1.

Applicants: Murray Alan Gillingham and Ruth Gillingham, 115 Takahiwai Road, RD 1, Whangarei 0171.

Land Applied for: 1422 square metres; shown on LT 404186, being part of the former bed of the Takahiwai Stream adjoining Allotment 138 Parish of Ruakaka comprised in Computer Freehold Register NA115D/364 in the District of Whangarei.

I hereby give notice of my intention to bring the land applied for under the provisions of the Land Transfer Act 1952 and issue a title for it in the name of the applicant unless a caveat forbidding the same is lodged on or before 11 June 2010.

The applicant claims the right of way easement is redundant by reason of the circumstances set out below.

I intend to remove the right of way easement on 31 May 2010 if no objections have been received before that date.

Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision in DP 83277 and the easement no longer serves the dominant tenement.
