Notice
- Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 6) 2010.
(2) This notice shall come into effect on 2 April 2010.
- Interpretation—In this notice:
(a) "customary food-gathering" has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) "Tangata Kaitiaki" are local dialect words that have the same meaning as "Tangata Kaitiaki/Tiaki", a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) "Tangata Kaitiaki" means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.
(d) "area/rohe moana" means the area described by a line commencing at Waipohutukawa at 37°43.34′S and 174°49.30′E; then proceeding due east to the boundary of the Waikato Settlement; then proceeding along the Waikato Settlement boundary generally south to a point due east of Matawha Point; then proceeding due west to Matawha Point at 37°55.20′S and 174°46.50′E; then proceeding due west to the outer limit of the New Zealand Exclusive Economic Zone; then proceeding generally north following the outer limit of the New Zealand Exclusive Economic Zone to a point due west of Papanui Point; then proceeding due east to Papanui Point at 37°53.12′S and 174°45.39′E; then proceeding generally north following the mean high-water mark to the point of commencement.
The geographical coordinates named are in terms of the WGS84 datum.

Nomination of Tangata Kaitiaki—Aramiro, Mai Uenuku Ki Te Whenua, Poihakena and Waingaro Marae, collectively representing Ngāti Mahanga, Ngā Toko Toru, Tamainupo and Tainui-Tāhinga, have nominated Maioha Kelly and Ledgeman Thompson (Aramiro Marae), Dave Huirama and Quinton Moore (Mai Uenuku ki Te Whenua Marae), Paddy Taipari Kaa and Phillip Kereopa (Poihakena Marae), and Kaiwaka Riki (Waingaro Marae) as Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

Appointment of Tangata Kaitiaki—On 20 March 2010, the Acting Minister of Fisheries confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Dave Huirama, Paddy Taipari Kaa, Maioha Kelly, Phillip Kereopa, Quinton Moore, Ledgeman Thompson and Kaiwaka Riki as Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

Confirmation of tangata whenua—Ngāti Mahanga, Ngā Toko Toru, Tamainupo and Tainui-Tāhinga, as represented in respect to these appointments collectively by Aramiro, Mai Uenuku ki Te Whenua, Poihakena and Waingaro Marae, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki relates.

Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana.
No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.
