Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 27 (Pan Pac Forest Products Limited)) Exemption Amendment Notice 2010.

(2) In this notice, the Electricity Governance Regulations (Exemption No. 27 (Pan Pac Forest Products Limited)) Exemption Notice 2004(^1) is called the "principal notice".

(3) This notice comes into force on 31 March 2010.

  1. Amendment to principal notice—(1) The principal notice provides an exemption from the requirement to comply with Rules 6.1, 6.4, and 6.5 of Technical Code B of Schedule C3 of Part C of the Electricity Governance Rules 2003 ("Rules").

(2) The principal notice is amended by omitting the date on which the exemption is stated to expire (31 March 2010) and substituting 30 September 2012.

  1. Reasons for amendment—The reasons for this amendment are as follows:

(a) Having consulted on proposed options to clarify the test in Rule 6.6 of Technical Code B of Schedule C3 of Part C of the Rules and related arrangements, the Commission has decided not to progress the proposed options until a wider review of automatic under-frequency load shedding requirements has been completed by the System Operator; and

(b) expiry of the exemptions prior to the test in Rule 6.6 being clarified would result in a short-term reduction in the supply of interruptible load in the North Island which may have adverse impacts on the energy and reserves markets.

Hazardous Substances and New Organisms Act 1996

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 ("HSNO Act"), the Environmental Risk Management Authority advises that it approved, on 23 February 2010, the Code of Practice HSNOCP 37-2 Hazardous Atmosphere Zones – AS/NZS 60079.10.1:2009.

This code is intended to provide a means of compliance with Regulation 58 of the Hazardous Substances (Classes 1 to 5 Controls) Regulations 2001 in respect of the standards for the delineation of hazardous atmosphere zones.

This code has been developed by ERMA New Zealand and enables AS/NZS 60079.10.1:2009: Explosive atmospheres – Classification of areas – Explosive gas atmospheres (IEC 60079-10-1, Ed.1.0(2008) MOD) to be used for the establishment of hazardous atmosphere zones.

Pursuant to section 80(1) of the HSNO Act, this code may be inspected on request at the Wellington office of the Environmental Risk Management Authority of New Zealand, Level 1, BP House, 20 Customhouse Quay, Wellington.

Notice of Approval of Code of Practice

Pursuant to section 79(5) of the Hazardous Substances and New Organisms Act 1996 ("HSNO Act"), the Environmental Risk Management Authority advises that it has approved, on 23 February 2010, the Code of Practice HSNOCOP 7-2 Fibre Reinforced Compressed Gas Cylinder to DOT-E 7235.

This code has been developed by Luxfer Gas Cylinders and provides a means of compliance with the requirements of Regulation 10(c) of the Hazardous Substances (Compressed Gases) Regulations 2004 in respect of cylinders for the transport and use of LPG.

Pursuant to section 80(1) of the HSNO Act, this code may be inspected on request at the Wellington office of the Environmental Risk Management Authority of New Zealand, Level 1, BP House, 20 Customhouse Quay, Wellington.

Pursuant to section 448 of the Maritime Transport Act 1994, notification is hereby given of the making of maritime and marine protection rules:

Part 40E: Design, Construction, and Equipment – Sailing Ships

Part 42B: Safety Equipment – Fire Appliance Performance Standards

Part 90: Amendment Rules

Part 200: Offshore Installations – Discharges 2010

All listed Rules come into force on 1 April 2010.
