The land is required for roading purposes and it is intended to use the land for the redevelopment and extension of Clark Street, New Lynn, Waitakere City, to cater for future traffic flows and town centre redevelopment.
The reasons why Waitakere City Council considers it is reasonably necessary to take this interest in the land described in the Schedule are:
(a) to cater for the additional traffic volume being generated as a result of the State Highway 20 termination at Maioro Street (and associated traffic work being carried out by Auckland City Council to cope with this);
(b) to meet the agreed objectives embodied in Waitakere City Council’s District Plan Change 17, that will enable New Lynn to meet the needs of a modern town centre;
(c) to meet the agreed objectives of the New Zealand Transit Agency, which recently gave its approval to the project, based on its ability to satisfy the requirements of that organisation’s funding assistance program.
The owner of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take the land and of their right to object.
Any other person having a right to object to the proposed taking of the said land may forward a written objection to the Registrar, Environment Court, Department of Courts, Level 8, 3 Kingston Street, Auckland 1010, or to PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days of the date of publication of this notice.
If any objection is made in accordance with this notice a public hearing will be held.
The objector will have a right to appear and be heard personally unless the objector otherwise requires.
Each objector will be informed of the time and place of the hearing.

The land to be taken is the leasehold interest in 1 Totara Avenue, New Lynn, Waitakere City, which is legally described as 1609 square metres, being Lot 3 DP 58386 comprised and described in Computer Freehold Register NA13D/869 and being all of the land leased under a deed of lease dated the 5th day of March 2009 between (1) Waitakere City Council and (2) Auckland Kindergarten Association. The area leased is shown hatched in red on a plan available on request from Waitakere City Council at the contact details above.
