Telecommunications Act 2001

Notification of Review of the Cost of Data Transmission in the Standard Terms Determination for the Designated Service of Telecom’s Unbundled Bitstream Access

On 12 December 2007, the Commerce Commission (“Commission”) made a standard terms determination (“STD”), under section 30M of the Telecommunications Act 2001 (“the Act”), in respect of the designated access service of Telecom’s Unbundled Bitstream Access (“Decision 611”).

Section 30R of the Act provides that the Commission may, on its own initiative, commence a review, at any time, of all or any of the terms specified in a STD.

Pursuant to this provision, the Commission is giving public notice that it has launched a review of the cost of data transmission determined in Decision 611.

This cost is deducted from the retail price of relevant broadband services in order to calculate the wholesale price of the Unbundled Bitstream Access (UBA) Service.

Electricity Governance Regulations (Exemption No. 40 (Pricing Manager)) Exemption Amendment Notice 2010

Pursuant to Regulation 196 of the Electricity Governance Regulations 2003, the Electricity Commission gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 40 (Pricing Manager)) Exemption Amendment Notice 2010.

(2) In this notice, the Electricity Governance Regulations (Exemption No. 40 Pricing Manager)) Exemption Notice 2007* is called the “principal notice”.

(3) This notice comes into force on 1 April 2010.

  1. Amendment to principal notice—(1) The principal notice provides an exemption from some of the requirements to comply with Rules 4.2, 5.4(e) and 5.5 of Schedule G6 of Part G of the Electricity Governance Rules 2003.

(2) The principal notice is amended by omitting the date on which the exemption is stated to expire (31 March 2010) and substituting 31 December 2010.

  1. Reasons for amendment—The reasons for this amendment are:

(a) the existing exemption has ensured that in setting prices, the Pricing Manager has operated with clarity and consistency;

(b) the existing exemption has ensured that the Pricing Manager has used the most appropriate instantaneous reserves information in the pricing process; and

(c) extending the exemption will allow time for a rule revision to be implemented.
