(d) in respect of any futures contract that is not made on or effected through a recognised exchange, the terms of the futures contract require that any transfer of obligations under the futures contract can be made only to a person who meets the criteria described in paragraphs (a) and (b) above;

and

(e) in respect of any futures contract that is made on or effected through a recognised exchange, any acquisition or disposal of the contract is effected through a person who is an authorised participant or member of the recognised exchange and who is authorised or licensed by the laws of the country in which it operates to deal in futures contracts on behalf of that person and to hold client money for that purpose;

and

(f) JPMSAL is licensed as an Australian Financial Services Licensee under the Corporations Act and holds an AFS Licence which authorises JPMSAL to provide futures advisory services to wholesale clients;

and

(g) JPMSAL notifies the Commission if JPMSAL’s AFS Licence is varied or revoked and notifies the Commission of any regulatory action taken by ASIC in relation to JPMSAL’s AFS Licence;

and

(h) JPMSAL provides the Commission with a copy of JPMSAL’s annual financial statements no later than three months after the end of each financial year for JPMSAL;

and

(i) JPMSAL notifies the Commission of any material matter concerning JPMSAL’s authorisation as a futures dealer.

Conservation Act 1987

Revocation of a Notice Relating to Conservation Areas and Issue of a Fresh Notice

Under section 50A of the Conservation Act 1987, and by reason of an error made in the notice described subsequently, the Community Relations Manager for the Southland Conservancy of the Department of Conservation revokes the notice headed Declaring Land to be Held for Conservation Purposes and Declaration That the Area Become a Reserve, dated the 29th day of November 2010 and published in the New Zealand Gazette, 2 December 2010, No. 164, page 4101, and issues the following notice in its place.

Declaring Land to be Held for Conservation Purposes and Declaration That the Area Become a Reserve

Under sections 7(1A) and 8(1A) of the Conservation Act 1987, the Community Relations Manager for the Southland Conservancy of the Department of Conservation declares that the land described in the Schedule is held for conservation purposes and further declares that the conservation area be set apart as a reserve, subject to the Reserves Act 1977, and classified as a scenic reserve, subject to the provisions of the latter Act.

A Proclamation

Pursuant to the Public Works Act 1981, I, The Right Honourable Dame Sian Elias, the Administrator of the Government, hereby declare the land described in the Schedule to be taken for road and to vest in the Crown on the 14th day after the date of the publication of this Proclamation in the New Zealand Gazette.
